UPDATE: Kaitlyn Hunt’s Bond Revoked; Evidence ‘Overwhelming,’ Judge Says

Posted on | August 20, 2013 | 386 Comments

Kaitlyn Hunt appears at Tuesday hearing.

UPDATE 3:10 p.m. ET: Elliot Jones reports at WPTV-TV:

Circuit Court Judge Robert Pegg revoked bond for Kaitlyn Hunt, and she’ll remain jailed until a trial, that’s so far unscheduled.
The judge also added a new charge to her court record — transmitting material harmful to a minor by electronic equipment, a third-degree felony.
“The evidence is overwhelming,” Pegg said in ordering Hunt held in jail without bail.
A tearful Kaitlyn Hunt, in a bright orange jail jumpsuit and shackles, periodically glanced at her father in the Indian River County courtroom, as Sheriff’s Detective Jeremy Sheppard testified about new evidence in her teen sex case having to do with being in contact with the victim via electronic equipment.

UPDATE 2:05 p.m. ET: Bond was revoked after Judge Robert Pegg described evidence of Kaitlyn Hunt’s violation of her pretrial release as “overwhelming.” An arraignment date was set for the new charges of transmitting “material harmful to minors,” and Hunt was escorted out of the courtroom and back to the Indian River County Jail.

UPDATE 1:50 p.m. ET: Kaitlyn Hunt was handcuffed and shackled and wearing an orange jail uniform when she appeared in court today, facing new felony charges of violating her bond and sending illegal graphic sex materials to her underage girlfriend.

Detective Jeremy Shepherd testified about the explicit photos and video Hunt sent to the minor, who is now 15. He said he was contacted on Aug. 6 after the younger girl’s father found an iPod that Hunt had given the victim in March. This was used to transmit more than 20,000 text messages, photos and video. Detective Shepherd said that while the explicit video that shows Hunt masturbating only shows the defendant from the waist down, he was able to identify her from her pierced bellybutton and tattoos.

Detective Jeremy Shepherd testifies at Tuesday’s hearing.

Judge Robert Pegg listens to testimony in Tuesday’s hearing.

UPDATE 12:55 p.m. ET: According to the court docket, prosecutors have filed a new felony charge of “Transmission of material harmful to minors to a minor by electronic device or equipment” (847.0138).

Kaitlyn Hunt has been reminded why they call it ‘jailbait’

Today is the bond revocation hearing in Vero Beach:

Accused Florida sex offender Kaitlyn Hunt returned to jail Monday night prior to a hearing today in which prosecutors will argue that her bond should be revoked and that the 19-year-old former cheerleader should be kept in custody until her trial on felony charges of having sex with a 14-year-old girl.
Hunt, whose case has attracted nationwide media attention, voluntarily turned herself in at the Indian River County Jail about 9 p.m. Monday night. She had been out on $5,000 bond since her February arrest, but last week prosecutors filed a stunning document alleging that Hunt had repeatedly violated the court-ordered terms of her pretrial release by contacting the victim in the case, who is now 15.
Ron Barnett of Barnett Bail Bonds in Vero Beach told the Palm Beach Post that it was Hunt’s decision to return to jail pending today’s 1 p.m. hearing before Circuit Court Judge Robert Pegg. . . .

Please read the whole thing at ViralRead. I’ll be updating later with news of today’s hearing, which should be interesting.

What is also interesting — and thanks to Jeanette Runyon for all her work in following this — is how Kaitlyn Hunt’s supporters, in order to argue for their lesbian heroine’s victimhood, find themselves obliged to demonize the parents of the younger girl:

In this, her supporters echo the arguments originally made in a May 17 Facebook post by Kaitlyn’s mother, Kelley Hunt Smith, who blamed the younger girl’s parents: “They are trying to send an innocent young girl to prison because they are full of hate and bigotry.”

Parents who are trying to raise their daughter right, and who expect Florida to enforce its own law — which sets age of consent at 16 — are being scapegoated by weirdos who want to make gay rights an argument to declare “open season” on 14-year-olds.

Legal stuff, I need to be careful with my terminology. Yes, I understand the hearing was to answer the question about violating the pretrial order: the point I wanted to make is the public must be careful about judging evidence during the pre-trial phase of a criminal case. The prosecutor gets to present evidence in the most damning light. Typically, as in this case, the defense has had no access to the presented evidence to be able to evaluate its validity.

An array of opinions? No, you’ve seen slight variations of Hunt is a
monster and the 15 year old who traded 20k texts with her is a “victim”.
And because I see just how completely ludicrous calling someone who
willingly engages in that activity a “victim” I’m suddenly pro-sex with
minors? No, Im not condoning Hunt’s behavior, just saying that it’s
absurd to call the younger girl a victim in the context of what
    happened.

How is it a straw man when you know as well as i do that if the 15 year old committed murder you would be calling her an adult and personally responsible. You guys do it all the time and are first line to sentence juveniles to life without parole for serious crimes. And again, they’re peers if they attend the same school and are on the same sports team. You have no logical or realistic argument other than to keep screaming about the arbitrary legal definition as to what constitutes consent and what age it can be given at which changes from state to state and country to country. And with that being said, Christbag, go fuck yourself.

You’re entitled to your opinion, but you’re also beating a dead horse. No one seems to agree with you, yet you keep reiterating the same point. We get it – you don’t agree with consent laws, as you’ve stated frequently you don’t believe the victim (in this case) is a victim, which she is. Give it a freaking rest.

Please feel free to point out where there is any actual dispute of the facts by the defense. And I mean that seriously, I am not attacking you.

So far, all I’ve seen from the defense are attacks on the charges, attacks on the motivations of the victim’s parents, attacks on statutory rape laws, etc. Lots of non sequiturs. I’ve not seen any actual attempt by the defense to dispute the basic facts.

Individuals with the same legal status and emotional development. Must have both, not one or the other. The Adult/Minor relationship is the stumbling block here. If the minor wasn’t a minor then there would not be any controversy. Thousands of boys in the position of Kate are prosecuted and convicted each year across the US, why should Kate be an exception? Because she is a lesbian? Fallacy! Equal treatment under the law is the request of the LGBT community. This has a downside as evidenced by this event.
Unintended consequences oft bite you in the ass. You cannot have your cake and eat it too (pun intended).

A straight A student at 12. Who the hell cares – and what is the relevance of your pre-teen grades? I don’t know where you were raised or what kind of special school you were in, but I never knew one person who had sex at 12.

and there we have it…straight from the horse’s mouth.

Maybe your parents were not successful in instilling you with any moral grounding but you have no right to push these values onto other children just so you can get affirmation for your own bad behavior. This is the LGBTQIWTF (or left for short) agenda in a nutshell.

  36. bobbydias

Do not forget that Katilyn started her part by saying to the so-called lover that she could not be a cheerleader anymore if she did not do as Katilyn told her to do. For much less the major news media organizations are treating the mayor of San Diego as some kind of devil. Be a male, you die. Be a female, you poor girl.

  37. wow
    August 20th, 2013 @ 10:51 pm

That is because 90% of you are neive. Do you think people broadcast when they had sex. No. Come on people. And having sex at 12, 13, 14 or 15 has nothing to do with my parents instilling morals, as a pre teen and teen you always find ways to do what you want to do that’s reality. The girl could have thrown the ipod away at any point and she chose not to. Not as innocent as everyone thinks.

  38. Ryan
    August 20th, 2013 @ 10:54 pm

At 12? I’d call that an outlier, not in the mainstream. Twelve is not a normal age to start having sex for anyone.

  39. Ryan
    August 20th, 2013 @ 10:58 pm

That is the nub of it. It’s not just about the age difference, it about the power relationship between the an adult and a minor, and it being abused.

  41. Stephen Rexroth
    August 21st, 2013 @ 12:03 am

LeonTrotsky1, apparently you’ve missed the point about what “grooming” of victims entails and how the whole point is to get younger, more impressionable victims to “consent”. You know, like those women that are put on the street as sex workers and then say they do it because their pimp “loves them” after he’s broken down their free will over weeks, months or years. That’s why statutory rape laws exist. If it was forced, it would be regular rape. Stat rape laws exist because we don’t want people in positions of power being able to coerce “consent” out of their victims. When 12-14 year olds run away from home to be with their 30+ year old “boyfriends”, is that okay since they obviously wanted it? Your statements are ignorant at best and frankly dangerous. Please educate yourself on child predation before saying anything else so patently stupid.

  42. Jay McHue
    August 21st, 2013 @ 12:09 am

Context: Florida’s age of consent is 16. Having sex with someone under that age makes that someone a victim. QED.

The only time a 14 year old is a “peer” with an 18 year old is when the 14 year old has something desired by the 18 year old. Typically, that means beer or available genitalia.

Anything else, the 14 year old is a kid.

@concern, I am the opposite of Piper3 and do in fact agree with you with regard to marriage etc.
However, I think that we need to listen to people on the other side who do in fact agree that there is something wrong with people who take advantage of what we classify as children.
The “victim” is under age. There is another issue that I saw raised indicating that Kaitlyn Hunt was applying the kind of pressure that should be considered abhorrent, no matter who is doing that kind of pressure.
For this reason, I will stand side by side with Piper3 and acknowledge that he/she has a right to agree with us on this particular matter. This kind of agreement happens a lot more times than you think. I am always amazed that this kind of agreement happens. Let us celebrate when we can agree.
