BRETT KIMBERLIN SUES BLOGGERS

The following joint statement has been authorized:

Convicted felon Brett Kimberlin has filed a Maryland lawsuit naming bloggers Aaron Walker, W. J. J. Hoge, Robert Stacy McCain, National Bloggers Club President Ali A. Akbar and the anonymous blogger “Kimberlin Unmasked” as defendants.
The defendants believe that the suit is without merit and is part of Kimberlin’s continued effort to use lawfare to silence journalists and bloggers who have written about Kimberlin’s criminal past. The defendants will not be made available for comment until they have finished initial consultations their respective legal counsel.

Media seeking comment may e-mail me (contact info is on the “about” page) and reporters who know my number can call, but as the statement says, I can make no comment for the record without advice of legal counsel. Of course, regular readers already know the Five Most Important Words in the English Language:

A search of court records reveals the complaint is for “DEFAMATION, MALICIOUS PROSECUTION, HARASSMENT, STALKING, CONSPIRACY, INVASION OF PRIVACY AND INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS.” It sounds like “accuse the accusers” on steroids, doesn’t it?
It will be fascinating to see how Kimberlin tries to assert that his reputation has been damaged — given that he has been convicted of setting off multiple bombs, one of which blew off a man’s leg, causing him to commit suicide. Doesn’t that tend to harm one’s reputation quite a bit more than stuff said by bloggers on the Internet?

You can’t duck discovery if you are the plaintiff, it almost guarantees the suit will be thrown out and you will be liable for defendants’ attorneys’ fees, as well as possible other sanctions for wasting the Court’s time.

I can’t see this getting beyond a hearing. Kimberlin is ineligible as a convicted perjurer in Maryland to file a sworn statement with the court. Any sort of defamation/harassment action requires that from the plaintiff.

As a prison trained prose sociopath litigant, Kimberlin files
lawsuits which the Maryland courts have trouble dismissing. And it is not because Kimberlin has properly pleaded his claims.

The defendants should get one learned counsel to file a motion to dismiss/motion for summary judgment to get rid of Kimberlin’s garbage lawsuit.

It is a fact of life that it is hard to get rid of a lawsuit filed by a wacked out, pro se sociopath.

As Adjoran notes, as a convicted perjurer he cannot even file a lawsuit. A motion to dismiss should be filed.

Since many don’t have the book, here’s some of the highlights:

The printer had called the FBI, and an agent with some backup was there pretending to be a customer, when Kimberlin came to get his order. The printer made up some apology about the job not being finished, and Kimberlin was leaving when

“The FBI man tackled him and bent one of his arms behind his back. With his free hand, Kimberlin wadded up and threw the prototype for the military IDs into a trash container. While being wrestled to the floor, he slipped the image of the [presidential] seal into his mouth and began chewing and swallowing it, then got his car keys from his pocket and slid them beneath the photocopying machine.”

Flat busted but apparently no knowing it yet, by Kimberlins story to Singer as follows:

” … I played it cool. I figured I had this uniform on and I figured maybe I could work it out”

The feds were not impressed, especially when he implied a secret mission. “I’m not allowed to disuss it” he prevaricated. But the agents were not very amused.

With that tack failing, he tried to talk the agents out of charging him by promising info about drugs related to both a prominent Ohio businessman, and a congressman (whom he did not name). To the agents credit, they demurred.

What follows is his rather desperate machinations involving the Impala later found to contain timers altered to be exactly like the ones used in the Speedway bombings, ball bearings (“inconveniently identical” to the ones used in the bombings) and crap, lantern fuel, and ammunition.

I’m just guessing here, but I’m pretty sure he ate the trunk key, or made sure to keep it off the main set he threw under the copier. He tried to bribe (my impression) some lawyer into getting the car away from the lot to a “safe place”. He went to get it when released , and got a surprise, the car had been impounded.

He then, reading between the lines, panics a bit (my impression) and went to confront the lawyer when he just happened by a newspaper box – and a paper with a headline suggesting the Bombings and the murder were connected. Out of ordinary interest, he stops and gets a paper and is floored, absolutely footed to discover the paper is alluding to a business man who must be himself!
