Some Salve For The Kagan Vote

Gary Marx at TNR has a little picker-upper concerning Justice Kagan, the bullet points of which I’ll repeat, but RTWT:

  1. This 63–37 vote was a victory for judicial conservatives.
  2. The climate regarding judicial nominations has been radically altered.
  3. Major interest groups that traditionally have not played a role in Supreme Court battles are moving toward the side of judicial restraint…
  4. There were some surprising no votes.
  5. Ultimately, the Kagan debate was about the size and role of the national government, and the role of judges within that government.

In summary, we have to hang in there and fight the good fight, even with an undesirable outcome. In a system full of compromise, making the downpayment on this fight affords a basis for subsequent victory. The opposition wants you to cry, punt, and let them complete the task of replacing our Federalist system with a crappy Socialist imitation that dishonors liberty.

To the defeatists we must say no, no, no, no, a thousand nos, and, again: get stuffed.

    Unfortunately we haven’t got a Kraken. At some point the Re publican’s have to realize that the left represents an existential threat to humanity. It won’t matter who we elect in November if they don’t understand the why or where their duty lies.

    If it were anything but a lifetime appointment I might agree with #1, but given its seriousness and permanance, I cannot.

    The upside of allowing Kagan through is that now if Ginsburg retires and Obama presents a radical replacement, it can be freely filibustered or blocked in committee, pointing to Kagan as evidence we are not merely being obstructionist.

    Obama has many worse nominees than Kagan on his list, believe me. Sure, she and Sotomayor will both be long-term disasters on the bench, but at least they are only holding the liberal seats of Souter and Stevens.

    Obama has many worse nominees than Kagan on his list, believe me. Sure, she and Sotomayor will both be long-term disasters on the bench, but at least they are only holding the liberal seats of Souter and Stevens.

    That kind of scared me a little. When I see TNR I am used to it leading to The New Republic not The National Review (NRO).

    It was only the qualities of perfidy and cowardice that made Republicans care if they are viewed as obstructionist. The mother preventing a bear from eating her child is considered obstructionist by the bear. If the elected-able Right doesn’t consists of at least 3 or 4 percent absolute lunatics we might as well give up on ballots and spend our time at the range.

    Its hard to find the silver lining with the last two appointments. We will be stuck with these liberal disasters at a time when so many important cases are waiting in the wings (health care, Arizona immigration and the gay marriage issue to name a few).
