‘Speedway Bomber’ Brett Kimberlin was sentenced to 50 years in 1981

“I have filed over a hundred lawsuits and another
one will be no sweat for me. On the other hand,
it will cost you a lot of time and money . . .”

ROCKVILLE, Maryland
More than nine months after convicted bomber Brett Kimberlin filed his vexation Maryland lawsuit, Kimberlin v. Walker, et al., we’re still wading through the preliminary motions. I’m here today for another hearing in these tedious proceedings. John Hoge has mentioned the hearing. We will update you if anything newsworthy happens.

    There was at one time a little-used component of the Federal Rules of Civil Procedure which allowed an exasperated judge to fine plaintiff or his counsel for filing a frivolous law suit. You hear about this Kimberlin crew and you figure that the State of Maryland needs such a rule – applied often.

    There are still fines, but only for very specific and repeated violations. However, he could be designated a vexatious litigant, which would require
    approval from a judge before any legal action could be filed.

    Most states automatically recognize the federal designation, so it would be significant.

    All today’s hearing did, as I understand it, is to set a trial date of August 11, dependent upon the motions for summary judgment that both sides have filed.

    I understand the defense’s motions, because the filings are so weak it should not go to trial, and Kimberlin should be designated a “vexatious little twit” and forbidden from being seen or heard in public.

    But is there ever summary judgment for a plaintiff in a civil trial? Perhaps if it is an action to enforce a previous court order, but I’ve not heard of a damage claim being summarily granted. WTF?
