Iowa Court OKs 17-Year-Old Strippers

It’s art!

Nude dancing is still an art form in Iowa, at least at a strip club in the tiny town of Hamburg.
The Iowa Court of Appeals on Wednesday dismissed the state’s request for a review of the issue. The request followed a judge’s 2008 decision that Clarence Judy, then-owner of Shotgun Geniez, didn’t violate the state’s public indecent exposure law.
Judy was charged after a 17-year-old girl stripped onstage in the southwestern Iowa club in 2007.
Iowa law makes it a criminal offense to allow minors to perform a live act intended to arouse patrons. But Fremont County Judge Timothy O’Grady ruled that the strip club was protected because the law doesn’t apply to theaters, art centers, or other venues devoted to the arts or theatrical performances.
O’Grady said prosecutors failed to prove the club wasn’t a theater.

Emily Geiger at Iowa Republican is “pissed off,” and Shane Vander Hart says:

Not that I have personal experience, but I fail to see how a strip club named “Shotgun Geniez” could be mistaken to be a theater or art center.

It happens all the time, Shane. Guys innocently set out to find the local art center, accidentally stumble into a strip club, and spend several hours stuffing dollars into the dancers’ garters before realizing their mistake.

UPDATE: Comment of the Day:

I don’t want to get a lap dance from someone who needs help writing a history paper.

Ouch.

Shotgun Geniez is a great name for a skin club.

I got dragged to a club out in Iowa called Whitetails a few years ago—pretty bushleague.

It’s happened to me before … Hanging out with a few buddies, drinking beer, discussing the nuances of classical art, you know … culture.

Certain we were heading out to the theater, you can imagine our surprise when all the girls were taking off their clothes!

It’s happened to me too. I was shocked, but didn’t want to offend with a hasty exit, so tried to play it cool. They didn’t have any Pernod so I was force – forced I tell you – to drink tequila shooters and draft beer.

The barmaid kept bringing my change in the form of singles, and well, I had to do something with them…

@Carin – no I haven’t, but you are ok with minors performing nude?

@Stacy – this was about the club owner who put the girl onstage, not the patrons. No patron was charged.

So was evidence presented showing that the owner knew she was 17?

I suppose SVH also is against 17 YO’s joining the military? Or is taking your clothes off worse than learning how to kill?

At least they aren’t calling the 17YO a “child”.

Shane: in some jurisdictions, the patrons probably could be charged for participating in child pornography or the like.

That said, the same people who think that the First Amendment allows the federal government to completely forbid certain types of electioneering speech also think that the Bill of Rights protects strippers. It begs the question: could Congress prohibit strippers from raising funds for a candidate within 60 days of an election?

lol, yes, use this defense when a 17 year old shows up in porn:

“But your honor, I didn’t know she was only 17! She looked 18 and a half! Honest!”
