Wal-Mart Wins, Women Lose, Stocks Rise

Posted on | June 20, 2011 | 24 Comments

The Supreme Court sided with Wal-Mart against a bunch of malcontents claiming “gender discrimination,” and the Dow Jones Industrial Average climbed 76 points.

Mere coincidence, I’m sure we’ll be told – the Wall Street rally is being attributed to encouraging news on the Greek debt crisis — but it seems to me that the court’s pimp-slap to the class-action tort-mongers had to be a welcome relief to Corporate America. Here’s a video from, of all places, Al-Jazeera:

I don’t go to wal mart very often, but there never seem to be any men working there.

When is a woman not a victim?

  • jwallin

Women didn’t lose. They were trying to pull a fast one lumping every female employee into one category when the were at different levels and positions within the company. Not enough similarities to be considered a ‘class’.

    That’s why the ruling.

This is a common trick used by lawyers of similar ilk as John Edwards. Claiming a ‘class’ is being discriminated against or harmed as a ‘class’.

A ‘class’ has to have similiar identifiers and circumstances to be one.

Lawyers like class action suits as they get mucho bucks and the plaintifs get pennies. They also can be easier to win as the ‘evidence’ used is so broad (see what I did there) that they can get away with more than if the case was individualized.

I think class action suits should be abolished. They invite trouble and the sharks can’t resist.

It’s not “how often” you visit one, but how many different Walmarts you have visited, of the 4000 or so, which might be more pertinent to your neglect of probability bias.

  • JeffS

When the woman in question is not a leftie.

  • JeffS

Somewhere, Amanda Marcotte is weeping.  In rage and frustration.

  • Anamika

When the woman in question happens to be a false feminist, fake hockey mom, mama phony grizzly, etc… or in other words, a Sarah Palin.

  • JeffS

In newspeak, “False feminist” = “Not a leftie”.  So you just said what I said, in your native tongue.

  • JeffS

PS:  You should re-read your “neglect of probability” link up above.  Specifically:

….the subject disregards the probability in making the
decision by treating each possible outcome as equal in his reasoning.

Or maybe try this one instead.

  • JeffS

Dang, that link didn’t work!  Try this one.

JeffS says “When the woman in question is not a leftie.”

IOW, ALL leftie women are victims, while rightie women are NEVER victims.

Now read up links on “bias.” Nah, just skip it. Read up on “hypocrisy.” That i think will serve you better. What? Sorry, i can’t provide you any link. You need to find them yourselves.

  • JeffS

IOW, ALL leftie women are victims

You said it first.  Not me.

    You own this one.

Quit feeding the troll. It’s attention she craves.

I hate all the 5-4 USSC decisions.

  • Joe

Oh, I thought you were going to say, when the woman is an ignorant lefty troll.

According to the lawsuit that was brought, claiming Walmart discriminates at the managerial level, the claimants freely admitted that Walmart’s alleged “gender discrimination” is just as apparent in their sales staff breakdown (70% wimmins)… but that’s discrimination against Members of teh Patriarchy™, so it’s all good, right?

  • JeffS

    Too obvious, Joe.  Too obvious.

    Still…it had to be said.

Whilst eating a pint of Cherry Garcia and using one of her stuffed animals as a handkerchief, as reruns of Sex And The City play softly in the background.

Oh why can’t a woman be more like a man?

  • Nospam

So, by your definition, gender has less to do with biology than it has to do with… ideology?
In other words, “woman” isn’t something one is born being, but something you become after professing faith?
Thus: There’s a whole lot of childbearing MEN (by your definiton, i.e. possessors of a double-X chromosome who don’t vote Traitor…sorry, Democrat) out there.

    Has anyone informed Ripley’s?

  • Nospam

    Thank God most aren’t!
