The Terrorist ‘Dreamer’: End DACA Immediately, and Deport Them All

The standard application fee for a B-2 tourist visa is $185, a sum that most Americans would consider trivial. In poor Third World countries, however, $185 might be more than a week’s pay, and that’s just for the application — paying $185 doesn’t guarantee the visa will be issued.

Keep that information in mind, as we discuss Abraham Hermosillo Alvarez, a Mexican who arrived in the U.S. in 2001 at age 6 along with his family, traveling on B-2 tourist visas. They never went back:

Federal officials say Abraham Hermosillo Alvarez, identified in court documents as the alleged ringleader of a plot to attack the White House UFC event this past weekend, was in the country illegally after overstaying a visa, according to information from Fox News Digital.
According to Homeland Security information in the documents, Alvarez came to the United States as a child and received deportation relief through the Deferred Action for Childhood Arrivals (DACA) program in 2014 after failing to leave when his B2 visa expired in 2001.
Five co?conspirators have been arrested this month in what investigators describe as a plan to use explosive?laden drones to force an evacuation from the event, followed by sniper fire aimed at the fleeing crowd. Federal authorities say Alvarez was responsible for planning, organizing and directing the planned attack.
Court records identified Alvarez as a foreign national after he consented to consular notification following his arrest this weekend, though the documents did not specify his immigration status or country of origin.
Immigration and Customs Enforcement has lodged a detainer for him following his arrest by the FBI in Omaha, Nebraska, on the day of the event. . . .
According to the Department of Justice, Alvarez used the name “Shepherd” in a group chat dedicated to planning the attack and allegedly responded “as many and as deadly as we can get” when asked about making drones with explosives.

Andrew R. Arthur explains an important point about B-2 visas:

Lauren Bis, DHS acting assistant secretary for media relations, had the following to say about Alvarez and his alleged involvement in this purported plot:

This illegal alien from Mexico should never have been allowed in our country. He was the ringleader of a failed terror attack targeting UFC Freedom 250 at the White House. … He and his co-conspirators now face charges of conspiracy to commit murder and conspiracy to commit violence on White House grounds. He will face justice and swiftly be removed from our country.

Given that Alvarez was about six years old when he came to this country in 2001 on a B-2 tourist visa (likely with family), I wouldn’t go so far as to state that he “should never have been allowed” into this country, but (assuming the reporting is true), the fact he never left suggests that whoever brought him didn’t have the appropriate “nonimmigrant” intent, i.e., the intent to return home. …
And when nonimmigrants — and B-2 tourists in particular — fail to depart as promised, it makes it more difficult their fellow countrymen to come here temporarily, but legally, in the future. Let me explain.
Section 214 of the Immigration and Nationality Act (INA) governs the issuance of nonimmigrant visas at consular offices abroad, and subsection (b) therein states that an applicant for such a visa is “presumed to be an immigrant” — that is presumed to be coming here permanently, not temporarily — “until he establishes to the satisfaction of the consular officer … that he is entitled to a nonimmigrant status”.
That “214(b)” ineligibility is the most common ground on which consular officers deny nonimmigrant visas, and when nationals of a specific country have high nonimmigrant “overstay” rates, consulates tighten up their nonimmigrant-visa issuances.
While I haven’t handled an immigration case in over a decade, I remain an attorney in good standing and receive calls from U.S. citizens and green card holders who are attempting, unsuccessfully, to secure tourist visas for their parents and other loved ones to come to this country for a visit.
It breaks my heart, but there is usually nothing I can do. “Once bitten, twice shy” doesn’t just apply to unfamiliar canines. Untruthful and noncompliant nonimmigrant visitors ruin others’ hopes, plans, and reunions.

When we hear the phrase “illegal immigrant,” we tend to think of someone wading across the Rio Grande or being smuggled over the border, but these “visa overstay” cases are also a huge part of the problem: Foreigners get into the country on tourist visas, student visas or temporary work visas, and then just never go back. And as explained, these cheaters make it more difficult for honest people to get temporary visas. They pay their $185 application fee and then get turned down for a tourist visa because some State Department staffer at the embassy suspects they won’t return after their visa expires. Dear reader, I am personally familiar with such a case, and it makes me angry.

Speaking of angry, here’s Andrew R. Arthur on DACA:

For more than two decades, congressmen from both sides have tried to pass some form of “DREAM Act”, that is, an amnesty for aliens living in the United States illegally after arriving here — with and without their parents — as children.
And for nearly a quarter century, they’ve been unsuccessful, and regardless of how it turns out, this case is unlikely to further their cause.
The failure of DREAM Act legislation led the Obama administration to create DACA, which provides quasi-legal status to aliens who entered the United States while under the age of 16 before June 15, 2007, who were born after June 15, 1981, who meet certain educational standards, and who have not been convicted of certain crimes.
DACA was not created by Congress, or even by executive order or executive action, for that matter. Instead, it’s the product of a memo issued by then-DHS Secretary Janet Napolitano on June 15, 2012 (five months before that year’s presidential elections), that has become a political football ever since.
As its name suggests, DACA is a unique flavor of “deferred action”, an “inherently discretionary” exercise of “prosecutorial discretion” to which applicants have “no legal right”, though aliens granted deferred action don’t accrue periods of unlawful presence in the United States while in that status and are eligible to apply for employment authorization.
ICE is quick to add that “deferred action does not confer lawful immigration status upon an individual”, meaning that an alien granted DACA exists in a nether zone between legal and not.

How the hell has DACA survived? It’s not a law passed by Congress, nor is it an executive order. DACA exists because of a mere memo issued by Janet Napolitano 14 years ago, which ought to have been canceled the very day President Trump was first inaugurated in 2017, yet we still have many thousands of these DACA recipients in the country. Even if we stipulate that some of these people are potentially good citizens — having arrived here as children, through no criminal intent of their own, etc. — they have now had more than a decade to get their paperwork straightened out and obtain permanent legal residency (i.e., “Green Card” status) and go through the seven-year naturalization process.

The point here is that foreign lawbreakers make it more difficult for everybody else, in part because abuses of the immigration system make us Americans so angry that we start saying things like, “Mass deportation is the moderate option.” (Don’t ask about the extreme option.)

When politicians start using gimmicks like DACA to rig the system, it only compounds the anger among those of us who are smart enough to figure out that we’re being lied to, and who refuse to be guilt-tripped by a lot of “diversity is our strength” rhetoric or excerpts from the poetry of Emma Lazarus. Americans historically have been a pragmatic people, willing to apply practical common sense to any problem we encounter, but our leaders have taken advantage of our good nature by offering phony “reforms” and allegedly temporary measures like DACA that, upon closer examination, are really amnesty. Politicians know amnesty is unpopular, and therefore engage in attempted deception about what it is they’re doing. When we see through their charades and call them out, they then accuse of us of xenophobic bigotry: “RAAAAACIST!”

There is a certain handsome young fellow — an athlete and scholar from a fine Christian family — in a Latin American country famous for soccer and beef, who would very much like to visit the United States. About three years ago, this gaucho of the pampas was working in a coffee shop to earn his tuition when he made the acquaintance of an American girl who was spending her junior year of college studying abroad in a Spanish-language immersion program. Because the girl was very beautiful, of course the fellow at the coffee shop fell deeply in love with her. After she returned to America, the handsome young fellow went through the ordeal of trying to obtain a visa to come visit her (in order to meet the girl’s father, as is proper). He paid that $185 application fee and was turned down by some State Department hack at the U.S. embassy.

“Do not worry,” said the girl’s father. “This is the Biden administration. Once Trump gets in office, he’ll make Marco Rubio the Secretary of State, and my friend Marco will fix this problem.” The lovebirds are still waiting for this Hallmark Channel movie to reach its happy ending, but perhaps you understand my resentment of the status quo, where we’re expected to feel sorry for illegal aliens, even while the system makes life difficult for those who obey the law and follow the rules.

My interest in this issue is quite personal, and calling me a xenophobic bigot is only going to make me even angrier than I already am.

Remember: Mass deportation is the moderate option.

UPDATE: Welcome, Instapundit readers! It has been pointed out by commenters that Trump tried to end DACA, but that got overturned by a 5-4 Supreme Court, as if Cabinet secretaries can just determine immigration policy and, once such a policy is established, it can never be changed by any future administration. Exactly how that’s constitutional, I can’t understand. Neither could Justice Thomas:

DHS created DACA during the Obama administration without any statutory authorization and without going through the requisite rulemaking process. As a result, the program was unlawful from its inception. The majority does not even attempt to explain why a court has the authority to scrutinize an agency’s policy reasons for rescinding an unlawful program . . .

DACA was “unlawful from its inception,” and yet somehow it’s against the law to end it? It’s a mystery wrapped in an enigma.

Mexicans in Kansas

Seven people killed in two separate crimes. Suspects are in custody:

Suspects in a mass shooting a Kansas City, Kansas, bar, and a recent triple homicide are now charged with capital murder and could face the death penalty, the Wyandotte County district attorney announced Wednesday.
Wyandotte County District Attorney Mark Dupree Sr. released the amended charges against three men in two separate cases during a news conference.
Dupree first addressed the mass shooting that killed four people and wounded five others Oct. 6 at the Tequila KC bar near 10th Street and Central Avenue.
Two men, Hugo Villanueva-Morales, 30, of Kansas City, Kansas, and Javier Alatorre, 24, of Kansas City, were initially charged with four counts of first-degree murder. The victims who died in the shooting were Everardo Meza, 29, Alfredo Calderon Jr, 29, Francisco Garcia Anaya, 34, and Martin Rodriguez-Gonzalez, 58.

(Not one gringo killed in this bar, not even by a stray shot?)

Alatorre was arrested quickly after the shooting. Villanueva-Morales fled to Mexico, where he was arrested and was recently brought back to the metro area to face charges. Both remain in the county jail.
Dupree said Wednesday that Villanueva-Moreales and Alatorre are now each charged with capital murder for the four deaths. . . .
The district attorney’s office also announced amended charges against Ismael Caballero in the deaths of a Kansas City, Kansas, mother and her two children. Their bodies were found in a burning home at 29 N. Mill St. on Dec. 30. Kansas City, Kansas, police were investigating the deaths as homicides but have not said how the three victims died.
Caballero, 31, is charged in district court with capital murder for the deaths of the two children, Amerikha Rodriguez, 14, and Jean Carlo Rodriguez, 10, and is charged with second-degree murder for the death of their 31-year-old mother, Yazmin Rodriguez-Santilla.

Is should not be necessary to explain the point here, but I will: Some places in the United States have a long history of Latino settlement, with communities stretching back for generations, even centuries. One is not surprised by the large Mexican-American populations in California, Arizona or Texas, and we’re accustomed to Cubans in Miami, Puerto Ricans in New York, etc. However, on does not think of Kansas City this way, so when the headlines inform us that three guys named Villanueva-Morales, Alatorre and Caballero are charged with killing a combined total of seven people named Meza, Calderon, Anaya, Rodriguez-Gonzalez, Rodriguez and Rodriguez-Santilla in Wyandotte County, Kansas — well, what the heck is going on here? It appears, for example, that two gunmen can open fire in a Kansas City bar without risk that any of their bullets will hit someone who was actually born in America.

As evidence that our immigration problem is absolutely out of control, this situation in Kansas City is rather conclusive, but notice that this criminal mayhem in Kansas is just “local news.” If some deranged “alt-right” white guy had shot four Mexicans in Kansas City, CNN would be providing around-the-clock updates, but because it’s Mexicans killing Mexicans, nobody at the networks seems to care.

Americans Murdered in Mexico

Breaking news from the Salt Lake Tribune:

Three mothers and at least six children with Utah ties were killed Monday in Mexico, according to the victims’ families.
Three other children suffered bullet wounds, said Lafe Langford Jr., a relative of some of the victims. He said doctors from across the Mexican state of Sonora were coming to help, though they would prefer to fly the wounded and others to the United States.
“We can’t get a helicopter or any airplanes or airlifts,” Langford said, “and it’s going to be at least a six-hour journey to El Paso or Tucson.”
The crimes set off a wave of social media posts from the victims’ families expressing sorrow at the deaths and pleas for the return of those who had earlier been kidnapped.
Maria Rhonita Miller and four of her children died on a road in northern Mexico, according to Langford and social media posts.
The bodies of Dawna Ray Langford, 43, and Christina Marie Langford, 31, were found later Monday, Lafe Langford Jr. said.
The bodies of two of Dawna Ray Langford’s children, Trevor, 11, and Rogan, 3, also were recovered Monday. An earlier report said Christina Marie Langford’s baby daughter Faith Marie Johnson had died, too, but that turned out to be incorrect.
Social media posts from family of the victims said at least one of the children walked from the ambush site to the family home. Other children were found on the side of the road where the attackers abandoned them.
The families are from La Mora, about 70 miles south of Douglas, Ariz. They are a mix of people who worship with the mainstream Church of Jesus Christ of Latter-day Saints and polygamous offshoots. Lafe Langford Jr. said the killings happened near the town of Bavispe in the state of Sonora. The gunmen, Langford said, are believed to be members of a cartel from Chihuahua who encroached on another cartel’s territory.

Mexico has apparently descended into a condition of violent anarchy.

Deported Immigrant Sex Offender Caught by Border Patrol in Texas

Guarantee you won’t see this story reported on CNN:

U.S. Border Patrol agents assigned to the Eagle Pass Station arrested a convicted sex offender in Eagle Pass, Monday.
“Our agents are tasked with preserving our way of life and ensuring the integrity of our borders and the security of our communities,” said Del Rio Sector Acting Chief Patrol Agent Matthew J. Hudak. “Thanks to their hard work, another convicted felon, was prevented from entering the U.S. and is unable to do more harm.”
On Oct. 22, Eagle Pass agents arrested Mexican national Efren Arellano-Arreola, 35, after he illegally entered the United States. Records checks revealed he has a criminal history, including a conviction in February 2016 for Sexual Assault of a Child, in Dallas County. Arellano-Arreola was sentenced to serve five years in prison for that offense, and is registered as a sex-offender. Further checks also show that he was removed from the United States in January 2018.
As a convicted felon who has been previously removed from the United States, Arellano-Arreola faces a charge of 8 USC § 1326 — re-entry after deportation, which carries a maximum sentence of 20 years in prison.

Bob Price reports at Breitbart:

A search of Dallas County court records by Breitbart News revealed that Arellano-Arreola confessed in open court to sexually penetrating the mouth of a girl under the age of 17 with his penis. Following his confession, the judge of the 203rd District Court sentenced him to spend five years in a Texas penitentiary. He would serve less than two years in state prison before being deported by immigration officers.

To quote President Trump, “they’re not sending their best.”

Illegal Alien Causes Mayhem by Threatening to Shoot Bus Passengers

Margarito Vargas-Rosas was arrested Friday.

Bizarre news from Wisconsin:

The man arrested for allegedly threatening to shoot and kill people on a Greyhound bus Friday night was a previously deported illegal immigrant living in Chicago, Racine County Sheriff Christopher Schmaling said Saturday.
During a news conference Saturday afternoon at the Racine County Sheriff’s Office substation, Schmaling said Margarito Vargas-Rosas, 33, was being held in the Lake County (Ill.) Jail in Waukegan on pending charges of making terroristic threats, a Class I felony, and misdemeanor disorderly conduct.
The sequence of events leading to Vargas-Rosas’ arrest began on board a Greyhound bus bound for Chicago from Milwaukee on Interstate 94, Schmaling said. At 9:45 p.m., while the bus was in Milwaukee County, at least two passengers aboard the bus called 911 to report a man was threatening to shoot and kill passengers.
Milwaukee County deputies were unable to stop the bus and turned the call over to Racine County Sheriff’s Office deputies to make the stop, Schmaling said. . . .
In Kenosha County, the Sheriff’s Department there and Wisconsin State Patrol joined in trying to pull the Greyhound over, Schmaling said. Their assistance included spiking the bus tires. . . .
“The suspect was ordered out at gunpoint,” the sheriff said. “He did comply — rather reluctantly — but he was ultimately taken into custody without incident.”
There were 37 people on the bus, including Vargas-Rosas and the driver, Schmaling said. . . .
Schmaling said Vargas-Rosas, 33, works at a restaurant in Milwaukee and was taking the bus home to Chicago, where he resides illegally.
“I use the ‘illegally’ because we were notified by immigration authorities that Mr. Vargas-Rosas, the 33-year-old, has been in our country illegally and was deported some time ago back to Mexico, and by virtue of his actions (Friday) night, we see he’s back and threatening to kill Americans.”

Officials will send him back to his “sh–hole country,” again.

Obama Administration Let Illegal Alien Stay; Now the Girl He Raped Is Dead

Armando Rodrigo Garcia-Ramirez (left) and Jennifer Delgado (right).

Next time a feminist mentions “rape culture” or “violence against women,” ask her when she’s going to write about Jennifer Delgado:

An illegal alien who allegedly twice raped his 15-year-old stepdaughter now stands accused of murdering the girl after Obama’s Department of Justice refused to prosecute him on human smuggling charges. ICE officers were never able to deport the man despite a lengthy criminal history that includes charges of assault, burglary, and human smuggling.
Many opportunities to prevent the needless rape and murder of a young Texas girl slipped by the wayside before 36-year-old Armando Rodrigo Garcia-Ramirez twice impregnated his victim, Jennifer Delgado. In 2008, police arrested the Mexican national for assault. A local prosecutor chose to drop the charges, the Washington Times reported. In 2009, Garcia-Ramires found himself in custody — this time, charged with assault. Prosecutors also dismissed this charge.
In 2011, U.S. Immigration and Customs Enforcement (ICE) officers took arrested the man and attempted to deport him. A judge granted the man bond and released him. No further information about this case is currently available.
ICE officers took another shot at deporting Garcia-Ramirez in 2016 after he was arrested and charged with smuggling five illegal aliens into the country. ICE officers arrested him and asked the U.S. Attorney for the Western District of Texas to press charges. Claiming the lack of a good witness, the U.S. Attorney declined to prosecute.
By this time, the 36-year-old man had already fathered a child with the teenage girl who he would later kill, the Daily Mail reported. One month later, he impregnated the girl again.
Despite his criminal history, Garcia-Ramirez applied for legal status. The Obama Administration granted him a work permit.
In early March, Garcia-Ramirez asked the teenage girl’s mother to meet him at a bank so that he could give her some money they had been arguing over. The mother, identified in court records as “O,” left Delgado and her baby at home while she went to meet him at the bank.
Instead of meeting “O” at the bank, Garcia-Ramirez went to the house and shot the 9-month pregnant girl twice, killing her and her unborn child. He left the 1-year-old child unharmed and fled the scene, the Daily Mail reported.

Does anyone wonder why 63 million Americans voted for Donald Trump?

The Democrat Party refuses to enforce our borders because they have cynically calculated that they can import Democrat voters from Mexico. Meanwhile, many in the GOP support an open-borders policy advocated by lobbyists for business interests that have cynically calculated that they can import cheap labor from Mexico. Anyone who objects to this bipartisan anti-American consensus is accused of “racism” by the liberal media that speaks for the elite political/economic establishment.

Quite simply, the American elite — the influential insiders who control big business, politics, media and the education system in this country — have developed a hateful contempt for the American people. The elite’s anti-American prejudice (to call it what it actually is) expresses itself in accusations that Americans who seek to preserve constitutional government are guilty of racism, sexism and homophobia.

Because of their contempt for Americans, the elite who claim to care about women’s rights, and who present themselves as defenders of the Hispanic community, are willing to ignore a case in which an illegal alien is accused of raping and murdering a 15-year-old Hispanic girl.

You will be accused of “hate” if you call attention to this crime, and yet who is hating whom? There is a girl dead in Texas, as a direct result of the policies of the Obama administration, and isn’t murder about “hate”? Doesn’t everyone who voted for Obama bear some degree of responsibility for the crimes of Armando Rodrigo Garcia-Ramirez?

Go ask Jessica Valenti: What about Jennifer Delgado?

Go ask Amanda Marcotte: What about Jennifer Delgado?

Alexandra Brodsky, Dana Bolger, Lori Adelman, Zerlina Maxwell — all the feminists who have spent years claiming that “rape culture” is rampant in America — go ask them: What about Jennifer Delgado?

You will get no answer other than the sound of crickets chirping.

Mexican Murder Suspect Is Finally Deported After 13-Year U.S. Crime Spree

Mexican criminal Fabian Godinez-Oseguera deported by ICE.

This case “ought to make your blood boil,” indeed: Fabian Godinez-Oseguera was wanted on a warrant in Mexico for a 2000 murder. He fled to the United States and — despite multiple felony convictions here and having been repeatedly deported to Mexico — was still running around loose in Washington State until 2011:

A former Bremerton man has been transferred to the custody of the Mexican Attorney General’s Office to face murder charges there from 2000.
Fabian Godinez-Oseguera has been deported to Mexico four times in the past. Each time, he returned to Kitsap County, where his wife and children reside.
Kitsap County Sheriff’s spokesman Scott Wilson said Godinez-Oseguera has had many interactions with local law enforcement, using a variety of aliases. He was arrested in 2006 by Bremerton Police under the name Francisco Ramos Campos for outstanding warrants ranging from marijuana possession to DUI to unlawful possession of a firearm.
According to Andrew Munoz, public affairs officer for U.S. Immigration and Customs Enforcement, Godinez-Oseguera is a documented gang member who has been involved in methamphetamine trafficking. He was remanded from Kitsap County Jail in October 2011 to the custody of ICE. He was presented for federal prosecution and sentenced. After serving a 13-month sentence at the NW Detention Center for Civil Immigration, ICE officers have now turned him over to Mexican authorities.

Let’s recap: A drug dealer and gang member wanted for murder in Mexico repeatedly returned to the United States “where his wife and children reside” and evaded apprehension for his crimes by “using a variety of aliases.” If that’s not enough to make your blood boil, how about this Obama administration press release?

A former Seattle-area man was deported by U.S. Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operation (ERO) Thursday to Mexico where he faces homicide charges.
Fabian Godinez-Oseguera, 37, also known as “El Güero Loco,” was turned over to Mexican authorities at the U.S.-Mexico border at El Paso, Texas.  . . .
“Criminals who seek to escape responsibility for their actions by fleeing to the United States will find no sanctuary in our communities,” said Nathalie Asher, field office director for ERO Seattle.

Three words: Bull. Fucking. Shit.

Foreign criminals are provided sanctuary in many U.S. communities. Michelle Malkin has written extensively about “sanctuary cities” like New York, San Francisco and Seattle that have an official policy of deliberate non-cooperation with immigration enforcement.

Has anyone ever heard Obama — or any member of his administration or any Democrat member of Congress — say a single critical word about these “sanctuary cities” that make an open mockery of our nation’s immigration laws? Of course not. They’re all liars.

They should be ashamed of themselves, but if they had any sense of shame, they wouldn’t be Democrats, would they?

‘Undocumented Workers’: Dating Underaged Girls Americans Won’t Date

Say hello to Jose Zarata, 25, described by a sheriff’s deputy in Maricopa County, Arizona, as “a non-U.S. citizen who has been living in the country without proper authorization.”

Turns out there were other things Jose wanted to do “without proper authorization,” such as dating the 13-year-old daughter of Maria Saucedo. She said “no,” so Jose shot her in the chest.

The Associated Press won’t call Jose Zarata an “illegal immigrant,” nor will they mention that the age of consent is 12 in Mexico, so we have to turn to other sources:

John Hill of the group Stand With Arizona Against Illegal Immigration blamed the crime on “the sick culture of Mexico,” where the age of consent is 12, and said Mexico ”rarely prosecutes child rapes.”

“Family values don’t stop at the Rio Grande,” President Bush said, but maybe those values are somewhat difficult to translate.

UPDATE: “Do you think the illegal immigrant obtained his weapon legally?”
