MY VIDEO of Michele Bachmann’s Christian Testimony Used in SMEAR JOB

This is so shocking I don’t know how to begin to describe it. Regular readers will recall that on Friday, Aug. 5, I covered an appearance by Michele Bachmann at the Spirit Midwest Christian Music Festival in West Des Moines, Iowa. It had been raining all afternoon before Bachmann arrived and gave her Christian testimony, which I recorded on video and posted the next day.

Some vicious monster ripped off my video and edited it, so that when Bachmann begins by jokingly asking the crowd, “Who likes wet people?” — because everybody was soaked to the bone, including me — instead there is a caption, “Who likes white people?”

Ken Layne of Wonkette then spread that smear all around the Internet.

Thank goodness, Chris Moody of Yahoo News spotted the lie and posted the truth.

Now, who do I sue for copyright infringement, piracy and fraud?

[A]fter I learned that my video had been stolen and misused for such a defamatory purpose, I put up a blog post denouncing the smear, and sent an e-mail to the anonymous proprietor of the “On Knees” Web site. He then deleted his first lie and substituted another vicious smear as a “correction.” But his pirated and re-edited version of my video — a clear violation of my copyright, and of YouTube’s terms of service agreement — is still online. I have spoken to an attorney and fully intend that the perpetrator of this crime will be brought to justice.

And I want the creep who did this to understand that he has just forfeited whatever legal right he had to anonymity. In pursuit of legal action, my attorney informs me, we can subpoena YouTube to get the actual name of this pseudonymous monster, who has made the mistake of picking the wrong dude to rip off in pursuit of his vile purposes.

By the way, Bachmann’s campaign manager is Ed Rollins, a guy who isn’t likely to take this kind of crap too kindly, either.

    Are they ever. Wonkette has always been leftist, but at least they were funny once upon a time. The last two or three years they’ve gone straight to hell. The posts aren’t funny and neither are the comments.

    RSM, it shouldn’t be that hard to figure out, but you’d better act fast before the edited video is taken down. Soak them for every dime you can get off them. Nothing would be cooler than seeing a leftist smear merchant out on the street. Show no mercy.

    If you’d see the EDITED version — the version PIRATED BY SOME DISGUSTING LOWLIFE CRIMINAL – you’ll see they take out the “winds and rains” part that might have provided some context.

    But it’s the PIRACY and COPYRIGHT INFRINGEMENT that have me roaring mad: I stood in the rain and mud to get that video, and for some DEGENERATE JACKAL to STEAL my work and use it in a DISHONEST SMEAR is enough to make me say he’d better start praying I never get my hands on him.

    No need in making a big mystery out of it. You’ve got the guilty culprit linked on your post, with the same YouTube username as on his blog, On Knees For Jesus. Here’s his YouTube home page which says he’s uploaded 297 videos. So you’ve got the person dead to rights. At the very least, he’s violated YouTubes TOS and you can have them take the edited video down. But if you’re really seriously considering suing the culprit, and I hope you are, it might be best to leave it up for the time being.

    I shudder to think of what they will do to Palin (again) but I think she is NOT thin-skinned and is probably the only one with the cajones to go after people like this you-tuber.

    That “God of the winds and the rain” part sounds a little pagan crazy, the rainstorm is the real missing context.

    Just to register my paranoia before the mindreaders steal my thoughts and go viral again, where this goes next is “Herman Cain blogger posted original Bachman Who Likes White People video.”

    Then they hit you with “Bachman video hatchet job featured Ladd Ehlinger-style editing, and guess who shared a car ride back from Iowa.”

    Finally, just when you think it’s gone away someone will dredge up a white supremacist heavy metal rock band named “White People” (whose to say it wasn’t there) and we’re off to the viral racetrack again.

    Better keep those lawyers on speed dial!

    Well, we obviously can’t be 100% certain until the culprit is outed, but it seems far less likely Bachmann did the hit on herself than, say, your being a jackass.

    Stacy, I applaud you for defending your intellectual property rights!

    We won’t know if a suit is likely to bring any significant damages until we know who the perp is – and face it, most of these little lefty snots are living in Mom’s basement or some starter apartment and if you seized all their personal wealth it wouldn’t pay the disinfectant bill.  But you never know . . .

    Attorneys cost money, and in this sort of situation you might get some help from a group or foundation – of course the attorneys will get paid off the top if you do win anything, but the point is to enforce your property rights and to make the offender pay.  The publicity won’t hurt you, and might discourage other would-be thieves.

    And make NO mistake, the perp is a common thief.

    Look, Charles: He STOLE MY VIDEO. He then edited it to create a LIE and uploaded that stolen work to his own YouTube account and posted it his blog. Let anybody say what they will about me, because I’ve got this guy dead to rights from a legal standpoint. Monetary damages aren’t likely to amount to much — the commercial value of a YouTube video isn’t a king’s ransom — but the wrongfulness of his actions are so blatant, he would damned sure be liable my attorney’s fees and court costs and, best of all, his anonymity is forfeited by the legal proceedings.

    I hope you reported him through the “abuse” button on Blogger.

    The other thing to do is craft a Limited Power of Attorney enabling readers of this blog to act as your agent regarding Copyright Infringement of the video.   Therefore they could go through the Google “report abuse” scree. That would allow all your readers to smash Google and yank the asshole on his knee’s site.
