Brett Kimberlin has filed his “Second Amended Complaint” in the federal RICO suit against myself and 20-odd other defendants. I’ll discuss it more at length later, but to give you just a hint of the insane desperation in evidence, Kimberlin has expanded his conspiracy theory to include HB Gary and “Team Themis.”

If those names don’t ring a bell, remember that former Anonymous spokesman Barrett Brown was obsessed with them.

Oddly, although Kimberlin now claims to be the victim of a conspiracy originated by “Team Themis,” none of those people are actually named as defendants. So the people who allegedly started this conspiracy get off the hook scot-free, while the self-proclaimed victim/plaintiff sues a bunch of bloggers? Does the pro se pipsqueak perjurer imagine that the judge won’t notice this paradox?

    Nothing surprises me anymore. Just a bunch of thugs led by a dwarfish bomber and pedophile who is controlled and master-minded by Neal Rauhauser. I believe he has stepped on his own crank with this 2nd amended complaint.

    Wasn’t he supposed to get permission before amending the complaint yet again? I suspect the judge WILL notice that much.

    THEMIS is a GOP leadership PAC. What the heck does that moron think they would have to do with HIM anyway?

    The judge gave permission for a second (and supposedly final) amended complaint, due no later than today. Based on the hilarity over at hogewash, it seems to be utter nonsense (not my own opinion because I have not been able to find a copy online as yet).

    That was the early hilarity. More hilarity was later added to the pot after a few reported on their reading of the amended complaint.

    On a brighter note, today’s antics vis a vis the NBC kerfuffle have certainly laid the groundwork for demonstrating a RICO conspiracy on their side when it comes time to claim damages for filing a crappy lawsuit.

    Mr. Hoge has put up a copy on his blog now. It is missing three pages (54-6) in the middle. Wouldn’t the lack of three pages in the middle of the complaint be problematic at best?

    Apparently so and both got blocked relatively quickly. If they think they can silence me again or that I’ll fall for their line of bull-crap they are sadly mistaken. They can attack me personally all they want, the truth of my past and reputation is worse than anything they can accuse me of. Let them waste their energy and time on me. Every minute that they spend on attacking me is a minute less they have for going against others who might be swayed by their con-artist tactics and false narrative. All I can say is “Bring it Bozos!”

    In the SCA BK seems to have decided to sue the “Ace of Spades” blog, not anyone who actually writes for it. However, the blog is NOT “Ace of Spades”, but “Ace of Spades HQ”. I would think that this means he is trying to sue a non-entity. The judge will probably let that slide, seeing as BK is pro se, but I can’t imagine it actually helps make that pile of fantasy look any less delusional.

    What is the likelihood that the judge, after considering BK’s second amendment, dismisses the lawsuit without any further action? ‘Without further action’ is defined as: BK is not disciplined and can bring the suit again in another court of his choosing? When does the Universe that was sued by BK go on the offense with counter-lawfare?

    the other thing with these Team-Themis-NSA-FBI conspiracy theory, is that it is legally irrelevant. The entire point in bring ing this up is to say that what we are doing is allegedly *like* what was being done.

    So its not that “they have been hired by HB Gary,” or anything like that. Just “this is something like what they are doing.” which is irrelevant. the issue is what he claims *we* did now. schmuck.

    Your problem is you assume his “jailhouse lawyer” reputation means he has legal skills, which his record of 2-113 (or whatever it is) belies.

    As a disinterested observer, it seems to me that Kimberlin doesn’t believe he is going to win any of these suits. He did not file them with any idea of winning. His intent is solely to harass, cause his victims to spend time and money, and to intimidate others who might write about him.

    Winning is irrelevant as long as losing costs him nothing. He probably claims indigence so he doesn’t even pay filing fees. After these cases fail, as have so many others before them, he will file new ones. And so on and so on and so on UNTIL some judge is fed up enough to pursue having him designated “vexatious” and limiting his ability to file more actions.

    respectfully, I think he was hoping for some kind of judgment–including a fraudulently obtained default–in his favor. I think his fundraising is in shambles and these suits are his bid to get it back on track. I think he is running out of money.
