As I explained yesterday, I didn’t blog much over the weekend because I was researching my defense against one of the accusations in the Kimberlin v. Walker, et al., lawsuit:

4. Defendants falsely wrote that other targets of theirs were part of “Team Kimberlin” and published that Plaintiff controlled, paid, and directed this vast network of “unsavory” operatives.

Proving the existence of Team Kimberlin will not be difficult, but fresh evidence is always welcome. A week ago, after I replied to a Twitter message from Ali Akbar, the “Breitbart Unmasked” Twitter account (clearly associated with Team Kimberlin) decided to taunt me, in an apparent show of support for fellow Team Kimberlin member Bill Schmalfeldt. Sunday, I noticed that “Breitbart Unmasked” hadn’t sent any further Twitter messages to Schmalfeldt. So I poked, and this morning “Breitbart Unmasked” responded:

So, Bill Schmalfeldt helpfully reveals, he has “regular phone conversations” with his fellow member of Team Kimberlin, which certainly would help to explain a situation I raised again Sunday:

Friday, I pointed out that Bill Schmalfeldt has claimed direct knowledge of Brett Kimberlin’s legal actions against myself and my co-defendants, joining his fellow Team Kimberlin members in premature celebration of their own imagined future vindication.
Bill Schmalfeldt claimed to know that Kimberlin served me with notice of his lawsuit in Maryland, but I don’t live in Maryland, and have not lived there since mid-2012. Therefore the question arises, who told Bill that I had been served at a Maryland address?

Ergo, the identity of “Breitbart Unmasked” (and likewise their fellow Team Kimberlin member “Xenophon”) is quite relevant to my defense in the case of Kimberlin v. Walker, et al., and Bill Schmalfeldt’s statement makes him a direct witness to these matters.

Quod erat demonstrandum.

Catch them telling the truth. Catch them telling a lie. Either way, so long as they refuse to exercise their right to remain silent, everything they say can and will be used against them in a court of law.

And their dishonesty is quite notorious.

    Kimberlin has a few more hours left to take me up on that offer to settle my portion of the lawsuit for a payment to me of only $1,000,000. As sone as my lawyer’s appearance hits the courthouse, that’s off the table.

    Just because BS *says* he has regular conversations with Team Kimberlin is no reason to believe it is, you know, the truth. It is in fact a good reason to disbelieve it.
    Because he surely is feeling very alone. He doesn’t have Tae Kim representing him any more. Why is that?

    And why do the TK people make fun of him behind his back?

    If his theory of the case is correct, isn’t that Gillette character a stalker? And since he is in the employ of VR, doesn’t that make Kimberlin a part of a conspiracy to harass?

    As I say, whether Bill (or any of them) lie or tell the truth is of no importance to this matter. If they are lying, the question is, “Why?” Honesty needs no motive. It is only deceit which need be explained.

    The point is that there is credible evidence that Aaron Walker et al., have been harassed by a number of entities who, collectively, we may call “Team Kimberlin.” Can any of these entities — for example, Neal Rauhauser — explain their motivations for acting on behalf of Brett Kimberlin? Rauhauser showed up in court hearings involving Kimberlin and Walker. And Mike Stack says Kimberlin attended a New Jersey court proceeding between Rauhauser and Stack. This evidence of cooperation between Brett and Neal (and I have just mentioned a couple of examples) is crucial, as are the behaviors of Schmalfeldt and various online pseudonyms such as “Xenophon.”

    That has been asked for repeatedly on twitter. They refuse. Also they refuse to even give a case name for where Kimberlin supposedly won a libel suit against Mark Singer. I guess when you tell lies you can’t very will provide proof.

    If there is no “Team Kimberlin” why do they sell merchandise with “Team Kimberlin” imprinted on it with the express purpose of supporting “Team Kimberlin” both on the Breitbart Unmasked site and Schmalfeldt’s multiple sites? Was this a scam? Did Schmalfeldt keep the money? Was it turned over to Kimberlin?

    You should ask Bill. You should ask and ask and ask, until he answers you. If Bill doesn’t answer, then you should start threatening him with terrible consequences if he doesn’t tell you what you what to know. Form your accusations as questions, see, and DEMAND that he answer you. Still no answer? Insult him. Photoshop his face onto gay porn pictures. Then you should harass Bill’s family members and their employers, and try to get them to give you the information you seek. You should write blog posts accusing Bill of multiple crimes that you are “investigating.” Then, report Bill to the IRS, FBI, DEA and every other law enforcement agency you can think of, accusing him of these crimes. Next, tell your readers that Bill is under investigation by these agencies, and that you expect Bill to be indicted, arrested, tortured, hanged, beheaded and drawn and quartered as punishment for the horrible crimes you know he’s guilty of.

    That’s what ethical journalists do, you know.

    The responses to my provocation from both Breitbart Unmasked and Bill Schmalfeldt are significant for different, but related reasons.

    Notice that Xenophon, although as dishonest as either of the other two, is also smarter than they are. In fact, while I’m pretty sure Xenophon is not a lawyer, Xenophon seems to at least have post-graduate education, and was careful not to get drawn into revealing anything.

    Xenophon likely views Schmalfeldt as the weak link (and correctly so), while Xenophon is probably disturbed that Breitbart Unmasked was drawn into the game I played with Schmalfeldt.

    Surmises about the motives and identities of online “personas,” however, are speculative. The clear fact, however, is that Schmalfeldt doesn’t know when to shut up.
