The hard question about King is not found in these far-fetched efforts to defeat its plain meaning. It rests instead on the massive disruption that this interpretation could impose on those individuals who, in good faith, purchased insurance on the federal exchange confident that they could gain the subsidy. The government’s defenders stress this point constantly even though they said little about the massive disruptions when millions of people lost their coverages in the original ACA rollout in the fall of 2013. The sad point here is that this latest transitional fiasco was largely avoidable. The Internal Revenue Service knew full well of the risk that it took and yet decided to plunge forward in its willful course of action. It would be distressing if the government’s conscious administrative overreach were rewarded, and it would be equally distressing if millions of innocent people were left in the lurch.
The hard question is whether it is the job of a court to ratify the sins of a government agency, given the dreadful precedent it would create for all future cases. The better choice, on balance, seems for the Court to strike down the IRS regulation and for Congress to work out some fix. That fix should not include expanding the coverage to federal exchanges, which would allow the Obama administration to work an illicit extension of the initial program. A far better suggestion is to make block grants to the states, which could fund subsidies to pick up the slack when the IRS regulation is struck down. The Republicans might well pass such legislation quickly and dare President Obama to veto it—which he might do to legitimate his own misconceived legislation.

When the pain comes, the temptation for the fools who think the ACA is a great idea is going to be to blame the conservatives who’re out to do the proper thing, and not the Pelosi-Reid-Obama Tridumbvirate that is properly responsible for this zombie abortion.

The idea that health insurance is a federal task is about as daft as Her Majesty running a private email server on her watch.

    I suppose crowd funding multiple ”teams” would be frowned on.
    If the way to make an illegal action made by the fourth branch legal is by creating hostage situations we are done.

    The groundwork is already being laid by the Democrats. Their new mantra is “the GOP needs to govern!” Never mind that a Congress governing over the top of a president is nearly impossible, even when they aren’t being obstructed at every turn.
    The citizens see the President as governing, because the point of contact between the citizen and government is at the point of execution. Congress can’t do that.
    If the subsidies are struck down, Democrats will cry out for a Republican fix. Fools like McConnell will actually try to accommodate them, and thereby implicate the whole party in the mess. He and Boehner have already demonstrated this by their caving on DHS funding, and effectively punting to the courts. They aren’t even able to defend their own power.

    Exactly. We know it’s coming, and we know we can’t avoid it by playing nice. So we should just boldly do the right thing.

    I listened to one of Ace’s podcasts the other day and he had a great idea. You know how barack always justifies his most outrageous actions by skipping the philosophy and issue talking points, right? He’s all, “Of course we need to nationalize healthcare, it’s just the right thing to do. It’s obvious, and every economist agrees.”

    In other words, he just lies, says it’s obvious and right, and then consigns your grandchildren to fifty years on The Rock.

    So when we repeal his Minim Opus, we should just follow suit. No excuses. No acting sheepish by our leaders in congress. Just state that every economist, doctor, and heathcare professional has been demanding this, and the people all agree that it’s the right thing to do.

    So you make a crappy law, and finding out that it’s rife with unintended consequences and in fact makes worse the situation it was supposed to fix, you double down and wing it, making up stuff as you go? When has that ever worked?

    If these rocket surgeons were in a boat taking on water, I swear to God their preferred solution would be to drill a hole in the bottom to drain it. When that didn’t work, they’d just drill more and bigger holes, all the while hollering “Stand back, I’ve got this! Don’t argue, you racists!”

    Just issue an EO and be done with it. POTUS does not need anyone’s permission to end something that’s unconstitutional.
