BREAKING: Maryland Appeals Court Denies Certiorari for Schmalfeldt Appeal

In a long list of cases dismissed without comment we find this news:

“Schmalfeldt v. Hoge — Pet. Docket No. 320.”

Will update with commentary, and expected rage reaction from the deranged cyberstalker. Two words, Bill: “Res judicata.”

UPDATE: John Hoge briefly acknowledges his victory. He has previously noted how Bill Schmalfeldt refers to the bloggers sued by Brett Kimberlin as “RICO Racketeers” — i.e., in effect convicting us of a felony, on the basis of false allegations in a ridiculous civil suit filed by the perjuring bomber I call The World’s Worst Pro Se Litigant™.

UPDATE II: Further comment from John Hoge:

I never had any serious doubts about Schmalfedlt’s appeal of the peace order failing. I did consider the possibility that the Court of Appeals would take the case in order to settle some point of law, but I never had any doubt about the order being upheld.
I would once again like to publicly thank my lawyer Zoa Barnes for her help with the case.

The RICO Racketeers™ would like to buy Zoa a steak dinner.

  1. This comes days after a Maryland court denied Mr. Schmalfeldt’s attempt to modify the peace order. Mr. Schmalfeldt was trying to secure an exception, desiring to harass Mr. Hoge so long as he used the word “story” or claimed it was “journalism.” Schmalfeldt failed to bring forth 48 exhibits, a criminal charge of perjury, and in his prediction that Hoge would be led away in cuffs during the court hearing. It’s worth reminding readers that the court suggested the original peace order. Schmalfeldt is an admitted violator of the peace order and the State’s Attorney office has warned him not to violate it again, lest he face serious prosecution.

  2. For those who don’t get the “res judicata” reference – that was the legal doctrine that Schmalfeldt ridiculed when preparing to argue his motion to modify the Peace Order. Basically, a motion to modify is not a trial de novo, where you get to re-argue admitted facts and settled matters of law. When Hoge mentioned the doctrine on his blog, Schmalfeldt proceeded to make fun of him for weeks, in his typical nasty style. Last week, of course, res judicata won the day when Schmalfeldt lost his motion to modify.

  3. Just so Bill Schmalfeldt et al. understand: the words “Res judicata” make no reference to joooooooos.

  4. And, lest I forget, Schmalfeldt took great delight in ridiculing Hoge’s attorney, Zoa Barnes, as often as possible, impugning her intelligence and competence in tweets and blog posts. News Flash: Zoa won.

  5. I feel like it has become a rallying cry of sorts for Hoge’s “Lickspittles” – he should add “RES JUDICATA!” to his Cafe Press gear.

  6. Congratulations to Mr. Hoge!

Oh, and as for Douchebag Bill and his “predictions”?

    BWAHAHAHAHAHAHAHAHAHAHAHA!!!!!!!!!

  7. Two comments:

    1. I am having a very good day.

    2. Stacy, it’s clear that you just don’t grasp The Schmalfeldt Standard of Journalistic Ethics™ yet.

  8. Can you sue the esteemed Mr Schmalfeldt, or is there nothing there worth suing?

Perhaps you can sue him for his ugly, and thereby own his face? 🙂

  9. BS this afternoon after the announcement:

“My part as an active combatant in this thing is over. From now on, count me an interested observer and writer.”

    That’s what he thinks.

  10. It’s amazing that he, 1) admits to lawfare, 2) believes that every court and every lawyer is wrong, 3) is using the “writer” line which was rejected already (forget the fact that it’s a lie). This dude is too used to failure.

  11. An example from this afternoon, a tweet from BS:

“This means any time some is annoyed by a reporter on Twitter, they just have to tell the reporter, “Leave me alone and never contact me.”

Well, yeah. And legitimate reporters publish that the subject of their piece had “no comment.” They don’t threaten to have the kids taken away.

  12. Maybe she should respond to BS with the “res Boudicca”. Stake him down while she goes and gets the chariot sharpened.

  13. Even in his loss, Schmalfeldt doesn’t get it. Notice the tweet in which he defends his ‘complete filing’ then proceeds to fling smears at Mr. Hoge’s lawyer. His actions and his words don’t match up.

  14. He has an iMac and several domain names. Also, finding out who has paid him over these past, oh say, 17 months might yield value itself. 😉

  15. The guys, my lawyer mom, and a few lawyers I’ve talked to hate me talking about this publicly. So I’ll simply say: YES, THAT’S MY FUCKING INTENTION! 🙂

  16. Sorry. I’m listening to rap music. I’ve been laughing at Bill Schmalfeldt for the past 3 hours. I need the rap music to take me to a different mental state. Hahaha.

  17. What part of “no comment” is so hard for Bill Schmalfeldt to understand? And how newsworthy was John Hoge before Schmalfeldt started harassing him?
