Yes, the World’s Worst Pro Se Litigant™ Brett Kimberlin Now Suing EVERYBODY

When I first heard the news this morning, my initial reaction was, “You’re kidding me. This has got to be a hoax.” But today at a Maryland courthouse — where Bill Schmalfeldt completely beclowned himself, BTW — the vicious creep actually delivered the news by hand:

Convicted bomber Brett Kimberlin filed a federal lawsuit Wednesday that names as defendants syndicated columnist Michelle Malkin, Red State editor Erick Erickson, talk radio host Glenn Beck, investigative journalist James O’Keefe and others, claiming they are part of a “criminal racketeering enterprise” under federal R.I.C.O. statutes. . . .
In addition to Malkin, Erickson, Beck, O’Keefe and others, Kimberlin’s federal complaint also names as defendants the late Andrew Breitbart‘s news site, two former Breitbart contributors, Lee Stranahan and Mandy Nagy, the non-profit watchdog group Franklin Center, O’Keefe’s publisher Simon & Schuster, Beck’s Web site TheBlaze.com and the award-winning conservative blogger known as “Ace of Spades.”
Also named as a defendant in Kimberlin’s federal complaint is Patrick Frey, the popular blogger known as “Patterico.” Kimberlin first threatened to sue Patterico in 2011 in an e-mail that included this warning: “I have filed over a hundred lawsuits and another one will be no sweat for me. On the other hand, it will cost you a lot of time and money …”

Please read the whole thing at Viral Read, and expect updates.

UPDATE: Kimberlin’s entire complaint will be posted online here soon. Meanwhile, I am issuing this Official Press Statement:

“Fuck you, Brett Kimberlin, you dishonest sociopathic creep.”

Please quote me on that.

  1. I’m dying to read the complaint. I am sure it will rank among the greatest works of fiction of the past decade.

I’m even more eager to see the countersuit(s).

  2. I expect it is modeled after the Miller-Jenkins RICO suit.

Which is every bit as ridiculous but still alive in court.

  3. Well, my guess is it’ll be stuck in the courts for a while. And here’s hoping discovery opens up a lot of things our favorite ex-con doesn’t like.

  4. I’ve said this on Twitter, but the biggest mistake was probably adding Simon & Schuster into the suit. Big publishing houses may have deep pockets (and I’m sure that Kimberlin is hoping for a big payday). but they tend to have even bigger and deeper legal departments. They are also known to spend more money fighting something than it would pay to make it go away, if only pour encourager les autres (or in this case pour décourager ou dissuader les autres).

If this isn’t thrown out quickly, I suspect that law students will be studying it for years as a “what not to do as plaintiff, and how to eat them for lunch as defendant’s counsel” case. Either that or as light amusement.

  5. I don’t know how helpful S&S will be for you guys. Big corps tend to settle quickly. OTOH, it could be a disaster for BK & Co, getting the invidious attention of a major media player.

    Will ‘Citizen K’ be reissued?

  6. I don’t know if S&S will settle, sometimes publishers want to make stuff go away, and sometimes they fight on principal, because in the long run they’d end up settling with too many people bring those sorts of suits in the hopes of quick paydays. And it would make great publicity for O’Keefe’s book.

  7. This is the sort of overreach which might finally make the Maryland judiciary recognize and sanction Kimberlin as a “vexatious” or “tortious” litigant – in most states that would mean ANY future legal filing would have to be reviewed and approved by an administrative judge first to weed out the garbage.

Without the garbage, Little Brett is just a short convicted bomber with an eye for underaged girls and a failed music career.

  8. Kimberlin most be hurting for money and using this suit against “all of the usual suspects” to get attention, support & sympathy from the liberal elites.

  9. That’s probably true, but nevertheless this still ranks extremely high on the weird shit meter.

  10. He personally served Hoge? Oh, so, another error on BK’s part. Is this the same Kimberlin who placed a bomb at a high school parking lot?

  11. Great opportunity to get Tides, Heinz and Streisand Foundations in the hot seats for interviews. And JTM and VR’s founding lawyers abd board members.

  12. Well, I think the plaintiffs want the suit dismisses forthwith, so there will be no discovery. Nevertheless, reporters can still do interviews, and BK just sued a bunch of ’em.

  13. You always knew you were a nobody/prole and now you have confirmation. I wasn’t included either, so I’m a fellow nothingburger. I’m used to it, though.

  14. I suspect something else. BK is making no friends in the Maryland courts with all of this. I suspect he will claim those same courts are biased against him in some other case.

  15. It’s over at the site for adjudicated harrasser Bill Schmalfeldt. I’d wait for it to be uploaded shortly by the good guys instead of risking who knows what to read it fast by the bad guys.

  16. Schmalfeldt just tweeted this: “We FOUND you, Akbar!” So, I guess he’s another member of the non-existent Team Kimberlin.
