Bullies, Braggarts and Fools

The Brett Kimberlin Fan Club has spent the past several days doing an online Happy Dance about Kimberlin v. the Universe, et al. The laughable falsehood thereof (see the responses by Ken White at Popehat and Patrick Frey at Patterico) doesn’t stop the perjuring bomber’s fanboys from celebrating what they imagine will be the annihilation of Kimberlin’s targets. My co-defendant John Hoge replies to one such fool:

If by some chance either of the suits survives a motion to dismiss, Brett Kimberlin will have to answer a lot of questions during discovery, and he will provide discovery this time. Because if he doesn’t, that will be grounds for dismissal. So either each suit is dismissed, or Kimberlin is subject to discovery, or he ducks discovery again and each suit is dismissed.
Of course, I suspect that one or more of the defendants is either or both of the suits will have counterclaims, and they will likely multiply after discovery. Also, I suspect that one or more of the defendants in either or both of the suits will be adding parties as part of their counterclaims. . . .

Read the whole thing. That Kimberlin has admirers who rejoice in his deliberate evil is one of the most amazing things about this story.

Fools who boast that their hatefulness will be vindicated by the forthcoming courtroom success of  The World’s Worst Pro Se Litigant™ are likely to be disappointed. But they have already covered themselves in such shame, they care not about their further embarrassment.

Bill Schmalfeldt’s wicked enthusiasm for anal rape — does anyone need to be reminded why Schmalfeldt is persona non grata at Daily Kos? — is entirely consistent with his depraved sadistic appetite for threatening the innocent and deliberately defaming the honest.

So a week ago, when Schmalfeldt was advised that his attempts to overturn John Hoge’s peace order against him were likely to fail, Schmalfeldt arrogantly and obscenely mocked this wise advice, and thereby accidentally prophesied the ultimate outcome:

Schmalfeldt’s humiliation in last Wednesday’s court hearing — even his hero Brett Kimberlin reportedly laughed at Bill’s clumsy arguments — was a result of his own bad judgment, and the Monday rejection of Schmalfeldt’s appeal made his humiliation complete.

Yet if Schmalfeldt were capable of learning from his own failures, he would never have made himself such a pathetic laughingstock, and so now he has set his heart on the success of Kimberlin’s flimsy RICO claim. Not content with this failure-by-proxy plan, however, Schmalfeldt decided to threaten Ali Akbar’s family — bad move, Bill.

Last night, Schmalfeldt got what he wanted. He got my attention. Over 30 tweets in 30 minutes that were brought to my attention by people concerned with my physical safety.
Schmalfeldt has bragged about beating people in drunken rages, about his weapons and he has written about calling his family members to physically harm people.
He called my mother, someone who raised three boys all on her own, all while going to school and working full-time, a whore.

See, I don’t believe in suing people, and it’s not my habit to call the cops, when my lawful means of self-defense are entirely adequate. But other people may not feel the same way, and if Bill Schmalfeldt is determined to continue hatefully harassing the innocent, he may be taught a lesson that even such a fool as himself cannot ignore.

  1. Based solely on their observable behavior, the only one of these guys who sees the potential scope of exposure if this suit advanced is Rauhauser. My prediction is that he will continue to “help” BK and BS by giving them awesome advice and spilling the beans via Twitter. Because NR is their friend, as he was to Barrett Brown.

  2. Remember, kids:

Bill Schmalfeldt is a Deranged Cyberstalker.

And he proves it every minute of every hour of every day.

  3. Really, not only is this guy a bully, braggart, and fool, he is dumb as a box of rocks. For someone who changes websites and Twitter handles the way most people change their underwear, you’d think he’d have the correct web address on his Tweets, but he doesn’t. But I digress.

I don’t like censorious douchebags, and I also don’t like liars. Schmalfeldt is a liar. He continues to threaten Ali in a new post because he needs to fight an “enemy” after his legal losses in the past week; so, he swiveled his reptilian gaze from Hoge to Ali, and lied in the process.

    1. Last night, he suggested that Ali’s mother was a whore, and who knows what else he has said in the past.
    2. He has, indeed, threatened physical harm – he has promised to send his family members to extract vengeance for imagined slights, and encouraged others to attack Ken White, Aaron Walker, Patrick Frey, and the Stranahans. He tried to hide these threats by calling them “satire.”
    3. If BS were, in fact, a journalist, he would be aware that there are over 27 kinds of 501 non-profits. Yes, folks, imagine that. Only donations to 501(c)(3)s are tax deductible, and organizations can and do change their status all the time.
    4. He never proved that anyone pimped their wife, just as he never proved that a child was born in a “bathtub” or anyone’s children were neglected.

    5. The Maryland AG does NOT exclude Twitter from the general harassment statute, as the judge has told Schmalfeldt over and over again.
    6. BS is a misogynist. He refers to the wives of the people he dislikes as whores and prostitutes and mail order brides, or when he says to Many Nagy, who has asked him not to contact her, that she is “up to her tits” in blah, blah, blah. He threatened another group of people, stating that he would own their wives. It is also clear from the way he speaks to his second ex wife via twitter. He accuses her of all sorts of things, yet never answers this question: if she and his other ex wife were such terrible mothers, why didn’t he seek or get custody of the kids instead of running off to play trucker?
    7. Hey, Bill, WHO IS JERRY FLETCHER?!
    8. RES JUDICATA!!!

  4. A Schmalfeldt modus operandi is to threaten the family and friends of someone with whom he has a beef. He does this again today. He has a dispute with Ali, so what does he do? Behold, because to quote RSM, the best way to discredit BS is to quote BS:

    1. “You are right that I accused someone of being a pimp for his wife. I also proved it. Shall we drag that out again, Akbar?” So, he threatens to bring in people whom he has defamed in the past with a promise to do it again. Why? This is nothing but a threat to keep Ali quiet.

    2. “And now begins our full and complete investigation of Ali Akbar, his family, his friends and everything he holds dear.
    And the best part is…
He asked for it.” Oh, like a rape victim asks for it?

Honestly, this guy is an execrable turd. Ken White asked a good question yesterday, and it was why aren’t more people on the right chipping in to help these guys fight the good fight? For heaven’s sake, if you are able to chip in $1 or $5 to their defense fund, please, please do it.

This is just disgusting. Now, I have to go try to rescue the abused dog down the street. Not kidding.

  5. Did anyone else snicker at the tweet from Bill about stumbling into court? Kind of an ironic description from someone that bitches about his parkinson’s at every opportunity.

  6. I think he doesn’t get the difference between a lawsuit with RICO and Criminal RICO charges..Two different animals..Sounds like he gets his legal advice from Neal, who has been breathing that story forever.

  7. Oh, about the dog? No worries, all legal. We are going to buy him and take him off their hands. We will keep him inside, not out in 30 degree weather, and get his head to toe mange and eye infections treated, not just let them go because he’s old.

  8. I’ll agree with Dianna, glad it isn’t a dangerous type of rescue. And thanks for mentioning this; I keep forgetting to make my cat’s follow-up appointment to have her stitches removed (breast cancer, kitty mastectomy, two looong incisions) and I only remember in the evening after the vets’ is closed. Appointment now made for Thursday!

  9. Bill asks what will they get by attacking him? Well, maybe if he reflected upon what he thought he’d gain by starting his role in the mess in the first place… well, that’s the answer. But that would require more introspection than he’s capable of.

I know you’re reading this Bill. I don’t know you, nor do I want to know you. Depending on your antics. I vacillate between contempt and pity. I am a lawyer, though I do not want to be your lawyer (I am not licensed to practice in Maryland). I will give you some general advice, but first a frank assessment. There is no way you can extricate yourself from the situation you have placed yourself in that does not involve pain. There is a non-zero probability that you can find yourself incarcerated. Here is how you can somewhat staunch your bleeding.

    1) Get a lawyer. Kimberlin is not a lawyer. Nor is NR. And if you think about their present situations (BK living in engineered penury to avoid paying a judgment and NR’s pretty much a fugitive for the same reasons) it would cast doubt on their legal wisdom. Besides, they have their own interests that may not be aligned with yours. You may not be able to afford a lawyer. Well, if you continue on your present path, the State of Maryland may be providing you one free of charge. (In that case, unless you’re pleading out, don’t represent yourself.)

    2) Listen to the lawyer, even or rather, ESPECIALLY, if he says things you may not want to hear. More importantly take his advice.

    3) Don’t discuss what the lawyer says- not to your friends, allies or especially on Twitter.

    4) Which leads to the most important point: STOP TWEETING! Seriously. You are not helping yourself. Venting your spleen at your ‘enemies’ give them more ammo. Your ‘journalism’ will just have to suffer.

  10. I may actually be the least of Bill Schmalfeldt’s problems. Some of the stuff many of us believe he has done rises well above the level of misdemeanors. Some of it is federal.

It took eight months of patient effort from the time I first filed for peace order until one was issued and now effectively upheld by the Court of Appeals. If the Cabin Boy thinks the last few months were stressful, he ain’t seen nothing yet. His time dealing with civil suits and likely criminal charges is just beginning.

He’s dug himself one helluva hole, and I’d say he was in it up to his neck—if he had one.

  11. I’d like to remind you all that Kimberlin’s primary Funder from 2006-2011′ the threshold foundation is yet to list their 2012 annual Rory even though 2013 is almost over. Are they hiding something?
