American Power is all up in arms about Kathy Griffin’s non-command of facts about #OccupyResoluteDesk’s record, calling BHO a Harvard Law Professor. This is misguided. In the Hope & Change era, we have moved on beyond facts.
Barack is as much a Harvard Law Professor as:

  • Elizabeth Warren is Cherokee
  • Harry Reid supports budgeting
  • Obama was a member of Led Zeppelin, which we’ll be exploring around noon, so check back.

I, for one, rejoice in the substitution of farce for facts by people in the media and government. This supports much more interesting blogging than dreary ol’ reality.

Junk My Dad Says About BHO

I usually call my dad on my drive home from work and commiserate. Dad had an interesting take on the whole literary agency ‘born in Keyna‘ business. He worried that the Obama camp is deliberately leaking the information that Breitbart is uncovering a means of rubbing the faces of patriotic Americans in the fact that we all got rooked, rooked, rooked in 2008.

I countered that, sure, we got rooked, probably more than we’ll ever know. I did come back at dad with the massive level of blowback Barack is facing across the spectrum is completely unheard of. The Obama campaign seems to be getting sacked of barely making it back to the line of scrimmage with every campaign play they try. Intrade still holds BHO with a 58.2% chance of re-election, for whatever that’s worth.

Short of Zombie Osama rising from the Potomac, and BHO vanquishing him with a Hong Kong Phooey Chop, I don’t see Barack turning this around, with this level of sustained pressure.

Update: Althouse evolves the theory more in dad’s direction. Ultimately, whichever direction the White House wants to spin matters stands a good likelihood of not being the useful one.

Domestic Terrorist Now Using ‘Lawfare’? Convicted Felon Kimberlin’s 501(c)3 Raised $1.8 Million in Six Years

When terrorist Brett Kimberlin was convicted of multiple felonies in 1981,
he could have been sentenced to 230 years in federal prison.

Federal tax forms filed by convicted terrorist Brett Kimberlin’s tax-exempt non-profit Justice Through Music Project (JTMP) show that the 501(c)3 group collected $1.8 million in gifts, grants and other contributions during its first six years of operation. An analysis using database research indicates that more than $300,000 of that sum came in the form of grants from tax-exempt foundations, including the George Soros-connected Tides Foundation, the Fidelity Investments Charitable Gift Fund, the Barbara Streisand Foundation, and the Heinz Family Foundation, connected to Democrat Sen. John Kerry’s wife.

Convicted of multiple federal felonies in connection with a string of 1978 bombings in Indiana, Kimberlin’s activities recently have come under renewed scrutiny due to his attempt to press criminal charges against attorney Aaron Walker, a blogger who says Kimberlin tried to “frame” him as part of a campaign of harassment and intimidation against conservative New Media activists.

JTMP’s 2009 IRS Form 990 (link is to PDF document) declares the “program service accomplishments” of Kimberlin’s organization: “Civil rights, social action and advocacy programs. We have created DVDs with musicians to educate youth about their voting and civil rights to get them to register and vote. We created a website to do the same, and we have held voter drives to educate youth and register them to vote.” On page four of the IRS form (question 43), the organization denied having engaged in “direct or indirect campaign activities on behalf of or in opposition to candidates for public office.”

Walker’s complaint against Kimberlin — the subject of a 28,000-word account posted Thursday morning at the blog Allergic to Bull — sparked new interest in the convicted felon’s online activities. Kimberlin’s connections to influential non-profit charities, leading progressive bloggers and Democrat Party operatives expose what many observers believe is a coordinated effort to silence conservative activists online through intimidation and harassment. Less than six months before his death, New Media enterpreneur Andrew Breitbart warned about Kimberlin’s activities.

The most recent IRS Form 990 available for Kimberlin’s JTMP (click here to view the PDF document) shows that the non-profit 501(c)3 group reported contributions of $223,739 in 2010. Combined with cumulative totals of contributions of $1,561,066 shown on the Maryland-based organization’s 2009 IRS filing, this means the Justice Through Music Project collected $1,784,805 from its founding in 2005 through 2010.

So-called “lawfare” harassment and other intimidation tactics by Kimberlin’s apparently well-funded network, including Democrat campaign consultant Neal Rauhauser, have alarmed those who see these efforts as a key component of a larger election-year strategy by liberal activists determined to dominate media coverage.

The Lonely Conservative blog has called for “an Army of Davids” to help expose Kimberlin’s activities, invoking the title of a book, An Army of Davids: How Markets and Technology Empower Ordinary People to Beat Big Media, Big Government, and Other Goliaths by Professor Glenn Reynolds, who has shown interest in the Kimberlin case at his popular Instapundit blog.

Non-Profit Cash for the ‘Speedway Bomber’

The Justice Through Music Project’s tax form lists only two officials: Kimberlin as director, with a full-time salary of $20,250 in 2009, and Bethesda, Maryland, attorney Jeffrey C. Cohen, who reported receiving no compensation for his role as the non-profit’s executive director. The tax-exempt organization’s IRS form lists its revenue for five years:

JTMP’s tax-exempt funding, including grants from major philanthropic foundations, is remarkable considering Kimberlin’s notorious record for violent crime and drug smuggling, as well as his convictions for perjury and impersonating federal officials. His 1978 terrorism spree — which earned him the sobriquet “Speedway Bomber” for the Indiana town where Kimberlin’s violent rampage occurred — included one blast outside a high school that maimed two people. Authorities said that, while awaiting trial, Kimberlin plotted to kill both the federal prosecuting attorney and one of the witnesses against him.

According to information available through online databases, it appears that JTMP’s funding by tax-exempt foundations peaked in 2006. That was the year Kimberlin’s non-profit received a $60,000 grant from the Tides Foundation, which has become controversial because of its funding from left-wing billionaire Soros. An analysis of database records appears to show the following foundation grants to JTMP:

Far be it from me to say that Ace is just slackin’ off over there in the Moronosphere, but I’ve been waiting for him to throw down on Kimberlin ever since I saw Aaron Worthing’s post Thursday morning, and now might be a good time for him to do so. Just sayin’ . . .

So it would be a bad thing if any of our readers misinterpreted this post as a suggestion they should go hassle Ace of Spades on Twitter.

Reacting to Aaron Worthing’s account of being harassed by convicted terrorist Brett Kimberlin (link is to the shorter summary), Donald Douglas writes at American Power:

The goal of these progressive cowards was to have me fired. And what’s so amazing is how seriously those contacted by my enemies took the lies and allegations against me. Carl Salonen even had an investigation at my college initiated upon the demand of California Attorney General Kamala Harris. . . .
For people like Aaron and myself, and so many others who’ve had their livelihoods disrupted simply for exercising their First Amendment rights, there is no other more important story than the progressive left’s campaign of political (and criminal) intimidation. . . .

Who Warned Us About Brett Kimberlin?

Less than six months before Andrew Breitbart died:

This was important, and Andrew Breitbart understood why it was important: The “TwitterGate” episode in October 2010 exposed Democrat operative Neal Rauhauser’s role in an apparent conspiracy to harass Tea Party activists online. Shortly thereafter, Mandy Nagy (aka “Liberty Chick”) documented Brett Kimberlin heinous criminal history.

Kimberlin and his “Velvet Revolution” partner Brad Friedman teamed up to urge Maryland authorities to prosecute James O’Keefe and Hannah Giles. At some point, according to Kimberlin, he became an “associate” of Rauhauser.

Now, investigative journalist Matthew Vadum has shown that major “progressive” tax-exempt foundations contributed tens of thousands of dollars to Kimberlin’s “Justice Through Music Project” and “Velvet Revolution” non-profits.

Money is fungible, as they say. The funding of Kimberlin’s projects — tens of thousands of dollars from the George Soros-connected Tides Foundation, as well as foundations associated with Barbra Streisand and Sen. John Kerry’s wife — thus supported all of Kimberlin’s activities, including his effort to have O’Keefe and Giles prosecuted for their ACORN takedown.

The association between Kimberlin, Friedman and Rauhauser inspires an obvious suspicion: Who is footing the bill for various online projects targeting leading conservative New Media activists?

Read Aaron Worthing’s account of being the target of Kimberlin’s attempted legal intimidation. Worthing’s offense? Apparently, being a former co-blogger with Patterico, who has written extensively about Kimberlin’s criminal record. Patterico has also been a target of Kimberlin.

Evidently, anyone who tells the truth about Brett Kimberlin is subject to this familar pattern of harassment and attempted intimidation.

Kimberlin is a notorious liar, who was convicted of perjury before he graduated high school and has been called a “world-class liar” by award-winning journalist Mark Singer. Just a few years after being released from federal prison, Kimberlin somehow managed to get funding from major donors and began passing himself off as an expert on “election reform,” becoming a favorite of the left-wing blogosphere by “repeatedly asserting as facts things that are not true,” as Time magazine’s Mssimo Calabresi wrote in 2007.

Now, it gets interesting: A site called “Breitbart Unmasked” has published a list of what it calls “The Breitbart Crew,” including everyone from Brent Bozell III to Dave Weigel of Slate.

Patterico and Worthing suspect “Breitbart Unmasked” and Brett Kimberlin are one and the same. On Twitter last night, @BreitbartUnmask denied being Brett Kimberlin, but it is curious to observe how people who tell the truth about Kimberlin become the subject of attacks from “Breitbart Unmasked.”

In 1981, Kimberlin was sentenced to 50 years in federal prison. But that was before “truth-in-sentencing” became law. He only did 17 years for his heinous crimes. A convicted terrorist who has been known to plot the murders of his enemies, including a federal prosecutor . . .

Names on a list?

Kind of what you might call a familiar modus operandi:

Brett C. Kimberlin schemed to elude justice with a series of bizarre plots designed to murder, maim and rob his enemies, create havoc . . . and discredit the chief government prosecutor. . . .
On sheets of yellow legal pad, Kimberlin asked another inmate in the Marion County Jail to arrange for the murder of Bernard L. (Buddy) Pylitt, the former first assistant U.S. attorney who coordinated his prosecution.
The offer contained a list of 10 names, including a potential prosecution witness, Robert Scott Bixler. Some names had crosses next to them. These indicated those marked for murder, it was learned. . . .

That article also mentions the July 29, 1978, murder of Julia Scyphers, the grandmother of a pre-teen girl toward whom, Gelarden wrote in 1981, Kimberlin had “strange affection . . . questionable relationship.” You might want to read the whole article. Given that Kimberlin has not pressed a libel action against the Indianapolis Star, we have no reason to doubt the accuracy of Gelarden’s reporting.

So far as I can discover, Brett Kimberlin has never admitted guilt for his crimes, nor has he ever apologized to those he harmed. Instead, he receives tens of thousands of dollars a year in funding from tax-exempt non-profit foundations.

Readers may ask: “What can I do?” One possible answer to this question is provided at the end of Aaron Worthing’s (very long) account of how he was harassed by Brett Kimberlin:

It is not the business of law enforcement authorities to mediate a personal squabble between Worthing and Kimberlin. Nor are officials interested in political controversies. However, this is not merely a personal dispute and it is not really about politics.

Brett Kimberlin is a notorious felon, convicted of multiple violent crimes, not to mention perjury, conspiracy and drug charges. His criminal record clearly indicates that Kimberlin is capable of unspeakable acts against those he designates as his enemies, including law enforcement officials. If Kimberlin is responsible for the “Breitbart Unmasked” operation, which is by all indications targeting those who tell the truth about Kimberlin’s criminal career, the possible implications — including the chance that this might incite criminal violence against targeted individuals — should seriously concern law enforcement authorities.

Andrew Breitbart tried to warn America, but we failed to pay attention to his warning. Is America paying attention now?

Regular readers of this site know that for some time the convicted domestic terrorist known as Brett Kimberlin has been harassing me. He did this because I dared to offer a bit of light, free legal help to a man he was suing named Seth Allen and then as he came after me, I told the truth about his deplorable criminal background and the fact he lied under oath in a hearing on November 14, 2011 and recommended that he be charged with perjury.

So this contradicts my earlier guess that Kimberlin targeted Worthing merely for being a Patterico associate. Exactly who Seth Allen is, or why Kimberlin was suing him, I don’t know. The point is that, so far as I know, Kimberlin’s only source of income is the grants he gets for his tax-exempt non-profit “charities,” which income he then uses to wage campaigns of smears, intimidation and harassment against anyone who criticizes him.
