    Issa should have remembered the First Rule of Not Acting Dumb: “1. If you don’t know, you better axe somebody!”

    Gowdy can be forgiven for being confused in the moment. Issa had time to check. Now he looks foolish.

    If you testify on your own behalf in a criminal trial, you can’t take the 5th. It’s a voluntary act, and it happens after you’ve seen all the evidence against you. That’s different.

    In a situation like Congress or a Grand Jury subpoena where testimony is compelled, you CAN take the 5th on a question by question basis.

    Even if there was a legal work-around, it’s not clear that anybody wants to be the one setting the precedent. Just because the IRS is odious isn’t an encouragement to emulate the scoundrels.
