The following press release was just posted:

Walker v. Kimberlin Complaint and Motion
for Emergency Preliminary Injunction

FOR IMMEDIATE RELEASE
June 22, 2012 – The Law Office of Bruce Godfrey, in professional cooperation with Dan Backer, Esquire, of leading Washington, DC, campaign finance and political compliance law firm DB Capitol Strategies PLLC, has today filed a Complaint and Motion for Emergency Preliminary Injunction on behalf of plaintiff and attorney Aaron Walker, Esquire against activist Brett Kimberlin in the United States District Court for the District of Maryland, Greenbelt Division.
Pending the imminent formation of a legal defense fund, the Law Office of Bruce Godfrey is participating in this litigation pro bono publico on behalf of Mr. Walker, due to the paramount constitutional principles at stake in the dispute outlined in the Complaint and Motion for Emergency Preliminary Injunction. No further discussion of the merits of the case would be appropriate here at this time, out of respect for the rights of Plaintiff Walker and Defendant Kimberlin to a fair and unbiased jury trial, which the Complaint requests on issues so triable. The relevant filings are available from the electronic filing and records systems of the United States District Court.
The Law Office of Bruce Godfrey is honored to participate in this case.

UPDATE: It was previously reported by David Hogberg of Investor’s Business Daily that Aaron Walker’s legal team has also filed an emergency appeal in Montgomery County (Md.) Circuit Courty (click here to see to see that filing). Walker was arrested May 29 at a Maryland hearing after Kimberlin had claimed that he was harassed because of Walker’s writings about Kimberlin’s criminal past.

UPDATE II: It is important to remember that Kimberlin’s “lawfare” intimidation against bloggers began in October 2010, when Kimberlin sued progresive blogger Seth “Socrates” Allen, whose complaints about Kimberlin’s tax-exempt group Velvet Revolution resulted in Allen being banned from a number of liberal blogs, including Daily Kos. Walker offered legal assistance to Allen, with the result that Walker himself (who had previously blogged under the pseudonym “Aaron Worthing”) became the object of harassment by both Kimberlin and his associate, Neal Rauhauser.

On May 17, Walker published his 28,000-word account, “How Brett Kimberlin Tried to Frame Me for a Crime (And How You Can Help!)” and, by the list of links below, you can judge how much news this saga has produced in the past 36 days.

REPORT: Aaron Walker Arrested After Maryland Hearing on Kimberlin Case UPDATE: Walker Now Released

UPDATE 6:25 p.m. ET: Sources say that blogger Aaron Walker has been released from custody in Rockville, Maryland. He was charged with “incitement,” but released on his own recognizance. Readers are encouraged to donate to the National Bloggers Club to help support Aaron’s defense against Brett Kimberlin.

*** PREVIOUSLY (11:59 a.m.) ***

FROM AN UNDISCLOSED LOCATION
Aaron Walker, whose complaint against convicted terrorist Brett Kimberlin became a conservative cause célèbre this past week, was reportedly taken into custody today after a court hearing in Rockville, Maryland.

One person who attended the hearing in Montgomery County District Court said that Kimberlin asserted that Walker’s continued blogging represented a violation of a “peace order” Kimberlin had obtained against the Virginia attorney, who says Kimberlin tried to “frame” him for assault earlier this year.

During the course of the hearing — which reportedly lasted about an hour — Judge C.J. Vaughey appeared to become increasingly hostile toward Walker, who was taken into custody when the hearing concluded.

On Thursday, May 17, Walker published a 28,000-word account of his experience being targeted by Kimberlin, which soon caught the attention of leading figures in online New Media, including University of Tennessee law professor Glenn Reynolds, who writes the popular Instapundit blog, and bestselling author Michelle Malkin, who warned her readers, “Please remember: Kimberlin is a radical, violent, lying, dangerous felon.”

UPDATE: According to a source, Kimberlin claimed during the hearing that he has received death threats as a result of Walker’s violation of the peace order. In 1981, Kimberlin was sentenced to 50 years in federal prison for his crimes, including the 1978 terrorist bombing that brutally maimed Vietnam veteran Carl DeLong.

UPDATE II: A copy of the “final peace order” (time-stamped 10:52 a.m.) states that Kimberlin is “in fear of imminent serious bodily harm” as a result of a “countless number” of death threats, and that “there is clear and convincing evidence that [Walker] is likely to commit a prohibited act in the future against [Kimberlin].”

UPDATE III: To understand what is going on here, please see my column today at The American Spectator:

During his time in federal prison, [Kimberlin] became a prodigious jailhouse lawyer, filing more than 100 actions on his own behalf, and his litigious habits have continued until this day. When Patrick Frey, the blogger known as Patterico, wrote about Kimberlin’s criminal past in 2010, he was immediately threatened with a libel suit. By then, Kimberlin had already sued Seth Allen, who eventually got legal assistance from Aaron Walker, a Virginia attorney who had blogged under the pseudonym “Aaron Worthing.” This evidently made Walker a target of Kimberlin’s harassment tactics, with the result that Walker says both he and his wife lost their jobs. . . .
Kimberlin’s critics say his litigation against Allen and Walker, and threats of action against others, are a type of “lawfare,” which is defined as “the illegitimate use of domestic or international law with the intention of damaging an opponent, winning a public relations victory, financially crippling an opponent, or tying up the opponent’s time so that they cannot pursue other ventures such as running for public office.” And this is part of what many see as a wide-ranging strategy of intimidation waged against conservatives . . .

Read the whole thing. I’m still trying to confirm facts about Walker’s hearing and reported arrest.

UPDATE IV: Just spoke to a source who confirms that witnesses saw Walker led out of the courtroom in handcuffs. Ali Akbar, president of the National Bloggers Club, Tweets:

Will know more on Aaron’s situation at 3:30/4:30pm.

The National Bloggers Club has created KimberlinFiles.org to help call attention to the case and to enable “supporters to make financial donations to a relief fund as a show of support.”

UPDATE VII: A witness blogs about the hearing:

It went bad for Walker pretty quickly. . . .
Judge Vaughey had read up on the matter, knew Kimberlin’s history of felony convictions, but clearly was technically ignorant of even basic facts about what Twitter is, in one instance point saying “He Googled you 500,000 times” through the Tubes or whatever. The Judge had identified himself, earlier, as being “of the Royal Typewriter Generation,” and at another point, when confronted with the voluminous material from both sides, asked “don’t people have jobs, who reads this stuff?”
That said, Judge Vaughey did know a lot about the kind of respect a Judge is owed. He also, again, knew all about Kimberlin, saying “even a prostitute is entitled to protection.”
And Walker pissed him off. So did Kimberlin, but Walker identified himself as a Yale-trained lawyer, albeit one who was representing himself. Kimberlin made any number of allegations — essentially, everything that was said about his side -– issuing death threats, harming business interests, summoning SWAT teams to the home–was said by Kimberlin to have been done by Walker’s side.
The pair went back and forth, back and forth, with Walker getting increasingly flustered, and the Judge finally asking, “what did they tell you in Yale Law School about interrupting a judge?”

My own source who was on the scene said of Judge Vaughey: “He couldn’t find the Internet to save his life.”

Brett Kimberlin’s Heiress Aunt Helping Fund His Tax-Exempt Harassment

FROM AN UNDISCLOSED LOCATION
Convicted felon Brett Kimberlin is the nephew of a wealthy Maryland woman who has contributed to a foundation that helped fund a 501(c)3 organization of which Kimberlin is the director. Kimberlin’s activities have recently attracted widespread attention because of his attempts to intimidate and harass bloggers who wrote about his criminal history.

Harriet Crosby, 66, reportedly an heiress to the General Mills fortune, was one of the original donors to the Threshold Foundation, which contributed $20,000 to Kimberlin’s Justice Through Music Project in 2008, according to database research I reported May 19.

The Threshold Foundation was started by a group of wealthy devotees of environmentalism and trancendental meditation. The foundation’s “very liberal” view, researcher Ron Arnold has written, “saw American society as rife with injustice and in need of radical transformation.” Threshold has been affiliated with the Tides Foundation, linked to left-wing billionaire George Soros.

A 2009 profile of Crosby in the alumni magazine of the elite Putney School — a private academy in Vermont, where the annual tuition is $46,900 for boarding students — described her as “active” in the tax-exempt non-profit group Velvet Revolution, which Kimberlin helped start in association with liberal blogger Brad Friedman.

Velvet Revolution gained notoriety by making unsubstantiated claims that Republicans stole the 2004 presidential election through vote fraud. A 2007 Time magazine profile of Kimberlin described how he “found a home in the blogosphere” by “repeatedly asserting as fact things that are not true.” At one point, Kimberlin offered a $100,000 reward for proof of his assertion that President George W. Bush’s re-election was obtained through vote fraud, a reward that was never paid. Velvet Revolution has also unsuccessfully sought criminal prosecution of various public figures including GOP strategist Karl Rove, the head of the U.S. Chamber of Commerce and the late New Media entrepreneur Andrew Breitbart.

The connection between Kimberlin and Crosby — verified by a 2009 article in the Montgomery County (Md.) Gazette — was reported today by Tee Zieldors, who credits independent blogger Seth Allen (whose Twitter account is @Preposterocity) for the tip.

It was Allen’s writings about Kimberlin that resulted in him being the defendant in a lawsuit brought by Kimberlin. Allen’s lawyer, Aaron Worthing, subsequently drew attention to his own experiences with Kimberlin in a 28,000-word account on May 17.

Kimberlin is scheduled to appear in a Maryland court Tuesday for a hearing about a “peace order” he has sought against Walker.

Kimberlin v. Walker Hearing Scheduled: 8:30 a.m. Tuesday in Rockville, Maryland

When terrorist Brett Kimberlin was convicted of multiple felonies in 1981,
he could have been sentenced to 230 years in federal prison.

Convicted terrorist Brett Kimberlin’s failed attempt to silence bloggers who tell the truth about Kimberlin’s criminality will be the subject of a court hearing Tuesday morning in Montgomery County, Maryland.

Kimberlin, who in 1981 was sentenced to 50 years in federal prison for his Indiana bombing spree and other crimes, has requested a “peace order” against Virginia attorney Aaron Walker, who says Kimberlin tried to “frame” him on an assault charge earlier this year. The final hearing on Kimberlin’s peace order request — which Walker has described as “frivolous” — is scheduled for Tuesday at 8:30 a.m. in Montgomery County District Court (191 E. Jefferson St., Rockville, Md. 20850), according to the court’s official Web site.

Walker, who has blogged under the pseudonym “Aaron Worthing,” gained unexpected national fame as a result of Kimberlin’s ongoing campaign of harassment and intimidation against Walker and his fellow citizen-journalists, including Seth Allen, Breitbart.com contributor Mandy “Liberty Chick” Nagy, Los Angeles deputy district attorney Patrick “Patterico” Frey and even the award-winning conservative blogger known only by his online pseudonym Ace of Spades.

Kimberlin’s misguided effort to suppress the truth about his violent criminal past — including the 1978 terrorist bombing that brutally maimed Vietnam veteran Carl DeLong — backfired disastrously.

Reacting to breaking news of Kimberlin’s escalating pattern of harassment, blogger Lee Stranahan declared that Friday, May 25, would be “Everybody Blog Brett Kimberlin Day,” a project that produced scores of posts about the man whom popular podcaster Jimmie Bise Jr. has dubbed “Lying Felon Brett Kimberlin.” As a result of this New Media publicity, both Frey and Walker were interviewed Friday on Glenn Beck’s nationally syndicated radio program.

Kimberlin began his criminal career as an adolescent drug pusher, and was convicted of perjury before he graduated high school. While serving time in federal prison for his numerous crimes, he made headlines in 1988 by claiming (without any substantiation) to have sold marijuana to Dan Quayle. Kimberlin has been described as a “top-flight con man,” in a Publisher’s Weekly review of the 1996 book by award-winning journalist Mark Singer, Citizen K: The Deeply Weird American Journey of Brett Kimberlin. His sole known source of legal income now is two 501(c) tax-exempt non-profit organizations, includng one funded in part by the Barbara Streisand Foundation.

The National Bloggers Club has created KimberlinFiles.org to help call attention to the case and, as the non-profit goup’s president Ali Akbar says, to enable “supporters to make financial donations to a relief fund as a show of support.”

Deadline Loometh, and the Raven Is Croaking Brett Kimberlin’s Name

THE KIMBERLIN FILES:

Three days of exposure — “The Army of Davids” effect that the Lonely Conservative cleverly invoked — looks like it was enough to push convicted terrorist Brett Kimberlin right over the edge. After nearly two years of Kimberlin apparently stalking and harassing his adversaries, the sudden burst of online publicity occasioned by Aaron Walker (aka Worthing) writing up a 28,000-word account of his own legal dispute with Kimberlin seems to have done the trick.

Remember that the “Breitbart Unmasked” Web site has denied — in a Twitter colloquy with me Thursday night — being run by Brett Kimberlin, which Worthing, Patterico and others long suspected.

OK, asked and answered — the denial is duly noted. Why, then, does that site exhibit such an obsessive interest in attacking those who tell the truth about Kimberlin? And why would the recent flurry of attention to Kimberlin’s activities cause Not Brett Kimberlin (as I’ve begun to think of “Breitbart Unmasked”) to post an unhinged 467-word rant on Saturday afternoon? Quoting that rant in its entirety:

Yes, This is Aaron Justin Walker Attorney at Law who blogs as Aaron Worthing @AaronWorthing and is a major Islamophobe who hates Muslims with a passion. He runs a blog called Everyonedrawmohammed.blogspot.com which is now set to private while he battles it out with the non profit Velvet Revolution, who had called him out on his Islamophobia. This is the face of dark evil. This is the man who would assume the mantel of launching a major assault on the institutional left, and with it a solid non-profit organization whose work has helped tens of thousands of people gain a better understanding of the process of voting and how that system has become corrupted by the influence of corporate money into the system. This is the man who has taken upon himself to launch an all out attack on everything that the left stands for. His lies are legend. His claims against Velvet Revolution and its foundations are nothing short of an attack on everything the left holds dear. Over the course of the next few weeks we will document everyone involved in this plot against this small non-profit organization that has taken everyone from Karl Rove, to Supreme Court Justice Clarence Thomas, to the out of control U.S. Chamber of Commerce to task. Yes, this small non-profit has called for massive investigations against these behemoths of the organized right to hold them accountable to the people. And because of that the right has responded with a full on outrageous assault on this non-profit in an effort to destroy everything they have accomplished. They call it #WAR. They call it #IAMANDREWBREITBART they call it a total commitment. OK, if its total commitment you want, it will be total commitment you will get.
Velvet Revolution has worked hard at dealing with this issue with the courts, and has contacted the FBI, the Attorney Generals Office, and everyone else that one can go to seek relief. The end result is that all of the parties that have been approached, contacted, or otherwise utilized, have all said that this is a battle they will not get involved in. So that is the way it will be. This will be a man to man knock down drag out fight for the hearts and minds, and a battle it will be. The message to the right wing extremists out there from BU is this: If you think we are going to be punked out and or bend over and let you stick it in then you are dead wrong. The rules you set up say that you and you only can attack people and get away with it, well, OK. Stand back and let loose the dogs of war then..
I hope you get that message loud and clear. Deal with it…

Oh, you are so frightened, aren’t you, Mr. Not Brett Kimberlin? Kind of externalizing and projecting your sociopathic habits on others, eh?

Horrified at the prospect of exposure, aren’t you? Trying to rally everybody around to protect your dishonest felonious self by conflating your own narrow interests with “the institutional left,” and exaggerating Aaron Walker into an all-powerful Right-Wing Ringleader, whom you accuse of orchestrating “all out attack on everything that the left stands for” and “everything the left holds dear” — like blowing up innocent people with bombs, for example?

Douchebag.

Your liberal buddies might be stupid, but I don’t think they’re so stupid they can’t recognize you as the selfish gutless weasel you are.

Let’s just state a fact that should be blindingly obvious: Stalking, harassing and attempting to intimidate bloggers who tell the truth about Brett Kimberlin’s notorious criminal history is not the kind of philanthropic activity for which federal law grants tax-exempt status.

Yesterday I posted links to the two most recent IRS Form 990’s for Kimberlin’s 501(c)3 organization, the Justice Through Music Project (JTMP), for which Kimberlin has collected $1.8 million since 2005, reporting $223,739 in contributions for 2010. If you’ll go to Page 7 of JTMP’s 2010 IRS filing (link is to PDF document), you will see that Kimberlin reported a salary of $19,500 for his full-time 40-hour-a-week job as JTMP’s director.

Forty hours a week. Full-time. Says so right there on the IRS Form 990 signed by Kimberlin “under penalty of law,” etc.

While thus serving as full-time director of a 501(c)3 non-profit, however, Kimberlin is also an “interested party” in the 501(c)4 non-profit Velvet Revolution, the director of which is Brad “Bradblog” Friedman. Now, if you will look at the IRS 2010 filing for Velvet Revolution (PDF), you’ll see that on line 38, they answer “yes” to this question:

“Did the organization borrow from, or make any loans to, any officer, director, trustee, or key employee or were any such loans made in a prior year and still outstanding at the end of the tax year covered by this return?”

Answering “yes” to question 38 required Velvet Revolution to attach Schedule L, “Transactions With Interested Persons,” wherein we discover that this 501(c)4 received a $4,500 loan from — OK, you guessed, didn’t you? — Brett Kimberlin. For the purpose of “paying bills.”

(CORRECTION: Dianna Deeley in the comments tells me I got this wrong, mistaking a loan from Kimberlin to Velvet Revolution for a loan from VR to Kimberlin. Fixed now. — RSM.)

So, riddle me this, Batman: How was it that Brett Kimberlin was serving as full-time director of the 501(c)3 Justice Through Music Project in 2010, while simultaneously serving as an “officer, director, trustee, or key employee” of the 501(c)4 Velvet Revolution. And why did he give them a $4,500 loan for “paying bills”?

Three words: Whiskey Tango Foxtrot?

Stipulate that there may be an entirely innocent explanation for this, and that we have no reason to believe that this apparent double-dipping by Kimberlin violated any actual law or regulation. But to cite noted legal scholar Ricky Ricardo, “You got some ‘splain’ to do, Lucy.”

Furthermore, the stated non-profit purpose of these organizations — the work which justifies their tax-exempt status — has no apparent relationship to the stuff they are accused of doing.

For example, why was Brett Kimberlin suing a blogger named Seth Allen? It was Kimberlin’s suit against Allen, remember, which led to the January courthouse encounter between Aaron Walker and Kimberlin that finally blew the lid off this mess. How is it that Kimberlin, while supposedly toiling 40 hours a week as director of JTMP and also being an “officer, director, trustee, or key employee” of Velvet Revolution, finds himself with enough spare time to go around suing measly bloggers nobody ever heard of before?

Who was Seth Allen until tort-happy Kimberlin decided to engage in an evident campaign of “lawfare” harassment against him?

Swear to God: I’ve been a full-time conservative blogger since March 2008 and never heard of Seth Allen until his name turned up in Aaron Worthing’s post Thursday. Exactly what did this hitherto unknown blogger do, that he became the object of this legal blitzkrieg by Kimberlin, who tells the IRS he’s working 40 hours a week as full-time director of a 501(c)3 tax-exempt non-profit, and who is also somehow simultaneously doing quite valuable work for 501(c)4 tax-exempt non-profit Velvet Revolution, yet finds time out of his busy day to go chasing after Seth Allen and declaring Aaron Worthing “The Face of Evil”?

Something is not adding up here, OK? Frankly, it reeks to high heaven, and I sure as hell ain’t the only one noticing the putrid stench emanating from the general direction of Brett Kimberlin. It smells a lot like the acrid odor of desperate crazed fear, don’t you think?

Aaron Worthing writes today about the “Streisand Effect,” by which Kimberlin’s attempt to suppress the truth has had the opposite effect.

More to come in a bit, but meanwhile, think about something a little birdie told me: When Democrat political operative Neal Rauhauser made an appearance in a New Jersey court Tuesday for a proceeding related to a criminal harassment complaint, guess who showed up at the courthouse with the defendant Rauhauser?

Yeah: Convicted terrorist Brett Kimberlin — or at least that’s what the little birdie says, and we have not yet seen any denial of that claim from “Breitbart Unmasked” Not Brett Kimberlin.

UPDATE: This is a huge story, and the problem — the reason it’s been fought out almost unnoticed in the blogosphere and on Twitter — is that it has so many different aspects that any attempt to tell the whole story all at once is nearly impossible.

As I’ve said before in trying to explain complicated weird stuff like this, when crazy things start happening, any person who tries to tell the story may sound crazy, because it’s hard to believe stuff like this really happens: Barbra Streisand gives money to a convicted terrorist? Crazy. Aforesaid terrorist starts getting his fingers into all kinds of pies, including WeinerGate and sundry lurid accusations against James O’Keefe? Crazy. Terrorist joins forces with Democrat campaign operative, pushing bogus legal hassles against a Los Angeles County deputy district attorney? Crazy.

Here I have just touched a few points on the tip of a vast submerged iceberg of craziness in this story. Yesterday’s 2,800-word “Joe Friday”-style report attempting to summarize clearly the main thread of the saga took me 13 hours to write and edit. And I was so busy yesterday, I didn’t even have time to do linkbacks to most of our many blogger friends who’ve linked that story.

Meanwhile, several bloggers who’ve been pushing on this Kimberlin/Rauhauser angle for months are kind of peeved at me for not having linked the work they’ve done. My apologies:

  1. There’s a crapload of this stuff scattered all over the place;
  2. Sources inform me of all kinds of internecine rivalries and mistrust among these bloggers, some of whom have said nasty stuff about Breitbart or other of my friends; and
  3. Kimberlin/Rauhauser have thrown up a lot of smear stuff about some of these bloggers, which I don’t have time to vet.

Most of (3), I’m sure, is just the usual smear stuff, but especially on yesterday’s main “Joe Friday” article, I didn’t want to muck it up with links to people whom I haven’t had an opportunity to vet, which might have given Kimberlin & Co. a chance to say, “A-ha! You cited so-and-so, who has three DUIs, two bankruptcies and a divorce” — you see what I’m saying, eh?

So, I’m not trying to glory-hog or ignore work done by others. I was just trying to boil down the main Kimberlin story into a tight narrative, so that the average reader could understand it and perceive the newsworthy relevance. Meanwhile, just for a sample of some of the stuff that’s being going on for months, here’s Dave in Queens from Feb. 7:

Ron Brynaert recently became a frontpaged blogger at BradBlog. Brad Friedman is a co-founder of Velvet Revolution. Hmmm. . . .
According to a court document from my case, it appears, imho, that by no later than December 21st, Neal Rauhauser had already obtained Aaron’s real full name.

What does this mean? I don’t know. Somebody sent it to me and said it was significant. Brynaert is a journalist who spent several years as an editor at Raw Story, and who might be grateful nowadays for paid work as a front-pager at BradBlog. My own personal hunch — and this is nothing but a hunch, mind you — is the Brad Friedman might be ready to throw Brett Kimberlin under the BradBus, and nobody in the progressive blogosphere would blame him.

There was evidently some point in time where Kimberlin appeared to have been an asset to Friedman, helping publicize and raise money for his blog, but put yourself in Friedman’s shoes now: Aren’t Kimberlin’s increasingly deranged antics making him a liability? Wouldn’t you hate to have your name continually linked with Mr. Perjury McTerrorist?

I think you would.

My hunch, then, is that at some point Friedman will weigh his options and tell Kimberlin, “Sorry, pal. Been nice working with you, but there’s only so much of your sociopathic crap I can deal with and still be an effective voice for the progressive cause. Bye, now.”

And by the way: One of those little birdies tells me there may be a connection between the “Anonymous”/”LulzSec” international hacker conspiracy and Brett Kimberlin. I know: Crazy.

UPDATE II: One of the pro-Kimberlin Twitter-troll accounts is now mocking me for having linked the awful nasty “Dave From Queens” blog, saying that “Dave” is actually Seth Allen, who has allegedly made himself a nuisance online but who — so far as I can tell — has never gone on a weeklong bombing spree in Indiana.

Which kinda matters, I think.

My point is that I’m trying to get at the facts of the case, rather than trying to judge the moral character of the people who are providing the facts. If Charles Johnson were to come up with something truly useful (and I’m told that Neal Rauhauser has now drifted into the LGF orbit), I might even be forced to quote CJ.

Keep in mind that if Rauhauser realizes his connection to Brett Kimberlin is exposing him (Rauhauser) to jeopardy, then Brett might also go under the wheels of the NealBus as well as the BradBus.

If my hunch about how this story plays out is correct — and hey, it’s just a hunch — then the Kimberlin/Friedman/Rauhauser nexus could explode into a frenzy of backstabbing and finger-pointing, as each tries to make his colleagues the fall guys for whatever evil craziness gets exposed, with no one wanting to become the scapegoat for the whole busted enterprise.

UPDATE III: One guy who did a lot to expose Neal Rauhauser’s “Beandogs” gang in the so-called 2010 “TwitterGate” episode is Patrick Read at Swift Read, who last month put up a post detailing the background on Rauhauser’s modus operandi, for anyone who might want to understand what a left-wing “hacktivist” can do.

Domestic Terrorist Now Using ‘Lawfare’? Convicted Felon Kimberlin’s 501(c)3 Raised $1.8 Million in Six Years
UPDATE: ‘Convicted of Perjury’

When terrorist Brett Kimberlin was convicted of multiple felonies in 1981,
he could have been sentenced to 230 years in federal prison.

Federal tax forms filed by convicted terrorist Brett Kimberlin’s tax-exempt non-profit Justice Through Music Project (JTMP) show that the 501(c)3 group collected $1.8 million in gifts, grants and other contributions during its first six years of operation. An analysis using database research indicates that more than $300,000 of that sum came in the form of grants from tax-exempt foundations, including the George Soros-connected Tides Foundation, the Fidelity Investments Charitable Gift Fund, the Barbara Streisand Foundation, and the Heinz Family Foundation, connected to Democrat Sen. John Kerry’s wife.

Convicted of multiple federal felonies in connection with a string of 1978 bombings in Indiana, Kimberlin’s activities recently have come under renewed scrutiny due to his attempt to press criminal charges against attorney Aaron Walker, a blogger who says Kimberlin tried to “frame” him as part of a campaign of harassment and intimidation against conservative New Media activists.

JTMP’s 2009 IRS Form 990 (link is to PDF document) declares the “program service accomplishments” of Kimberlin’s organization: “Civil rights, social action and advocacy programs. We have created DVDs with musicians to educate youth about their voting and civil rights to get them to register and vote. We created a website to do the same, and we have held voter drives to educate youth and register them to vote.” On page four of the IRS form (question 43), the organization denied having engaged in “direct or indirect campaign activities on behalf of or in opposition to candidates for public office.”

Walker’s complaint against Kimberlin — the subject of a 28,000-word account posted Thursday morning at the blog Allergic to Bull — sparked new interest in the convicted felon’s online activities. Kimberlin’s connections to influential non-profit charities, leading progressive bloggers and Democrat Party operatives expose what many observers believe is a coordinated effort to silence conservative activists online through intimidation and harassment. Less than six months before his death, New Media enterpreneur Andrew Breitbart warned about Kimberlin’s activities.

The most recent IRS Form 990 available for Kimberlin’s JTMP (click here to view the PDF document) shows that the non-profit 501(c)3 group reported contributions of $223,739 in 2010. Combined with cumulative totals of contributions of $1,561,066 shown on the Maryland-based organization’s 2009 IRS filing, this means the Justice Through Music Project collected $1,784,805 from its founding in 2005 through 2010.

So-called “lawfare” harassment and other intimidation tactics by Kimberlin’s apparently well-funded network, including Democrat campaign consultant Neal Rauhauser, have alarmed those who see these efforts as a key component of a larger election-year strategy by liberal activists determined to dominate media coverage.

The Lonely Conservative blog has called for “an Army of Davids” to help expose Kimberlin’s activities, invoking the title of a book, An Army of Davids: How Markets and Technology Empower Ordinary People to Beat Big Media, Big Government, and Other Goliaths by Professor Glenn Reynolds, who has shown interest in the Kimberlin case at his popular Instapundit blog.

Non-Profit Cash for the ‘Speedway Bomber’

The Justice Through Music Project’s tax form lists only two officials: Kimberlin as director, with a full-time salary of $20,250 in 2009, and Bethesda, Maryland, attorney Jeffrey C. Cohen, who reported receiving no compensation for his role as the non-profit’s executive director. The tax-exempt organization’s IRS form lists its revenue for five years:

2005 — $121,450
2006 — $428,815
2007 — $255,635
2008 — $558,543
2009 — $196,623

JTMP’s tax-exempt funding, including grants from major philanthropic foundations, is remarkable considering Kimberlin’s notorious record for violent crime and drug smuggling, as well as his convictions for perjury and impersonating federal officials. His 1978 terrorism spree — which earned him the sobriquet “Speedway Bomber” for the Indiana town where Kimberlin’s violent rampage occurred — included one blast outside a high school that maimed two people. Authorities said that, while awaiting trial, Kimberlin plotted to kill both the federal prosecuting attorney and one of the witnesses against him.

According to information available through online databases, it appears that JTMP’s funding by tax-exempt foundations peaked in 2006. That was the year Kimberlin’s non-profit received a $60,000 grant from the Tides Foundation, which has become controversial because of its funding from left-wing billionaire Soros. An analysis of database records appears to show the following foundation grants to JTMP:

Kimberlin’s infamous criminal past could scarcely have been a secret to those who funded his organization. Kimberlin became a national political celebrity during the 1988 presidential campaign because of his claim, made while he was still serving time in federal prison, that he had once sold marijuana to Dan Quayle, who was then the Republican candidate for vice president. Who Warned Us About Brett Kimberlin?

Less than six months before Andrew Breitbart died:

This was important, and Andrew Breitbart understood why it was important: The “TwitterGate” episode in October 2010 exposed Democrat operative Neal Rauhauser’s role in an apparent conspiracy to harass Tea Party activists online. Shortly thereafter, Mandy Nagy (aka “Liberty Chick”) documented Brett Kimberlin heinous criminal history.

Kimberlin and his “Velvet Revolution” partner Brad Friedman teamed up to urge Maryland authorities to prosecute James O’Keefe and Hannah Giles. At some point, according to Kimberlin, he became an “associate” of Rauhauser.

Now, investigative journalist Matthew Vadum has shown that major “progressive” tax-exempt foundations contributed tens of thousands of dollars to Kimberlin’s “Justice Through Music Project” and “Velvet Revolution” non-profits.

Money is fungible, as they say. The funding of Kimberlin’s projects — tens of thousands of dollars from the George Soros-connected Tides Foundation, as well as foundations associated with Barbra Streisand and Sen. John Kerry’s wife — thus supported all of Kimberlin’s activities, including his effort to have O’Keefe and Giles prosecuted for their ACORN takedown.

The association between Kimberlin, Friedman and Rauhauser inspires an obvious suspicion: Who is footing the bill for various online projects targeting leading conservative New Media activists?

Read Aaron Worthing’s account of being the target of Kimberlin’s attempted legal intimidation. Worthing’s offense? Apparently, being a former co-blogger with Patterico, who has written extensively about Kimberlin’s criminal record. Patterico has also been a target of Kimberlin.

Evidently, anyone who tells the truth about Brett Kimberlin is subject to this familar pattern of harassment and attempted intimidation.

Kimberlin is a notorious liar, who was convicted of perjury before he graduated high school and has been called a “world-class liar” by award-winning journalist Mark Singer. Just a few years after being released from federal prison, Kimberlin somehow managed to get funding from major donors and began passing himself off as an expert on “election reform,” becoming a favorite of the left-wing blogosphere by “repeatedly asserting as facts things that are not true,” as Time magazine’s Mssimo Calabresi wrote in 2007.

Now, it gets interesting: A site called “Breitbart Unmasked” has published a list of what it calls “The Breitbart Crew,” including everyone from Brent Bozell III to Dave Weigel of Slate.

Patterico and Worthing suspect “Breitbart Unmasked” and Brett Kimberlin are one and the same. On Twitter last night, @BreitbartUnmask denied being Brett Kimberlin, but it is curious to observe how people who tell the truth about Kimberlin become the subject of attacks from “Breitbart Unmasked.”

In 1981, Kimberlin was sentenced to 50 years in federal prison. But that was before “truth-in-sentencing” became law. He only did 17 years for his heinous crimes. A convicted terrorist who has been known to plot the murders of his enemies, including a federal prosecutor . . .

Names on a list?

Kind of what you might call a familiar modus operandi:

Brett C. Kimberlin schemed to elude justice with a series of bizarre plots designed to murder, maim and rob his enemies, create havoc . . . and discredit the chief government prosecutor. . . .
On sheets of yellow legal pad, Kimberlin asked another inmate in the Marion County Jail to arrange for the murder of Bernard L. (Buddy) Pylitt, the former first assistant U.S. attorney who coordinated his prosecution.
The offer contained a list of 10 names, including a potential prosecution witness, Robert Scott Bixler. Some names had crosses next to them. These indicated those marked for murder, it was learned. . . .

— R. Joseph Gelarden, “Kimberlin case a maze of murder, deceit,” Indianapolis Star, Oct. 18, 1981

That article also mentions the July 29, 1978, murder of Julia Scyphers, the grandmother of a pre-teen girl toward whom, Gelarden wrote in 1981, Kimberlin had “strange affection . . . questionable relationship.” You might want to read the whole article. Given that Kimberlin has not pressed a libel action against the Indianapolis Star, we have no reason to doubt the accuracy of Gelarden’s reporting.

So far as I can discover, Brett Kimberlin has never admitted guilt for his crimes, nor has he ever apologized to those he harmed. Instead, he receives tens of thousands of dollars a year in funding from tax-exempt non-profit foundations.

Readers may ask: “What can I do?” One possible answer to this question is provided at the end of Aaron Worthing’s (very long) account of how he was harassed by Brett Kimberlin:

Second, you can write to the State’s Attorney of Montgomery County. I did not name the subordinate responsible for the inaction, but ultimately it is the responsibility of John McCarthy, the State’s Attorney himself. You might also consider writing to the Governor, or the Attorney General of Maryland. Be polite. You will not help me by being foul or insulting. Simply state that you believe a grave injustice has been done to me—if you happen to agree—and ask them politely to see to it that justice be done.

It is not the business of law enforcement authorities to mediate a personal squabble between Worthing and Kimberlin. Nor are officials interested in political controversies. However, this is not merely a personal dispute and it is not really about politics.

Brett Kimberlin is a notorious felon, convicted of multiple violent crimes, not to mention perjury, conspiracy and drug charges. His criminal record clearly indicates that Kimberlin is capable of unspeakable acts against those he designates as his enemies, including law enforcement officials. If Kimberlin is responsible for the “Breitbart Unmasked” operation, which is by all indications targeting those who tell the truth about Kimberlin’s criminal career, the possible implications — including the chance that this might incite criminal violence against targeted individuals — should seriously concern law enforcement authorities.

Andrew Breitbart tried to warn America, but we failed to pay attention to his warning. Is America paying attention now?

UPDATE: It takes an “Army of Breitbarts” to overcome the indifference, inertia and bias of the mainstream media. One blogger can accomplish little on his own, and I am therefore grateful to all those who have helped call attention to the Kimberlin case, including:

UPDATE II: I Own the World is paying attention.

UPDATE III: Aaron Worthing returns with a brief summary of his 28,000-word original post, which makes clear the following:

Regular readers of this site know that for some time the convicted domestic terrorist known as Brett Kimberlin has been harassing me. He did this because I dared to offer a bit of light, free legal help to a man he was suing named Seth Allen and then as he came after me, I told the truth about his deplorable criminal background and the fact he lied under oath in a hearing on November 14, 2011 and recommended that he be charged with perjury.

So this contradicts my earlier guess that Kimberlin targeted Worthing merely for being a Patterico associate. Exactly who Seth Allen is, or why Kimberlin was suing him, I don’t know. The point is that, so far as I know, Kimberlin’s only source of income is the grants he gets for his tax-exempt non-profit “charities,” which income he then uses to wage campaigns of smears, intimidation and harassment against anyone who criticizes him. Please read the rest of Aaron’s summary.
